GRIEVANCE - PHILLIPS
Mr. Phillips. Is that reputation such as to entitle him to belief
under oath?
Officer King. No, sir.
(Under cross-examination.)
Page 5. Q(by Mr. Solomon). Now, how do you know Rudy H.?
Officer King. I saw him out in the hall. He was pointed out to me
by the prosecutor.
Mr. Solomon. And by this pointing out, you know his reputation?
Officer King. I heard from another source, from a prosecutor...
Mr. Solomon.(interposing) ....Another prosecutor?
Officer King. Yes, sir.
Mr. Solomon. Well, we have two (2) prosecutors. All right. Who was
it that told you about his reputation?
Officer King. Winfield Scott.
Mr. Solomon. Winfield Scott? Did any of his friends tell you?
Officer King. No, sir.
Mr. Solomon. You all have no mutual acquaintances?
Officer King. Not that I know of.
Mr. Solomon. Do you kno.; anyone in his place of employment?
Officer King. No, sir.
Mr. Solomon. In other words, you have two (2) representatives of
the District Attorney's Office, giving you their opinions of a
Defense Witness?
Officer King. That's correct.
The examination and cross-examination of Officer H.K. Sanders followed an
analogous pattern (Exhibit 'F', pp. 7-11).
The DALLAS GAY ALLIANCE contends that prosecutorial vindictiveness was
involved in Mr. Phillips' decision to call these police officers as witnesses
and that the eliciting of the testimony described above was intended to harrass
and degrade the defendant Rudy H. The following facts relate to the "Village
Station trials," which feature in concomitant grievances which we are filing
against District Attorney Henry Wade, and against Assistant District Attorneys
Winfield Scott and A.W. ('Bill') Arnold III.
1) Mr. Phillips was the State's prosecutor in two of these trials,
including that of Richard S. (No. 80-18891-H/B) on August 27/28,---- -- ---U- --
