That Plaintiffs were seized and pos-
sessed of the following lands, to-wit.. |
All that certain Lot, Tract or parcel'
of land lying and being situated in the
Wiggins Addition to the City of Miner- j
al Wells, Palo Pinto County, Texas, j
and being a part of the Wiggins Square
in said City, County and State, De-!
scribed by metes and bounds as follows: j
Beginning at a point on the North line
of the N. W. 7th Street and the South
line of Wiggins Square and beginning
at a point 63 ft. East of the Southwest
Corner of the Wiggins Square; Thence
East with the South line of Wiggins
Square 47 ft. to Cor; Thence North 100
ft. to Corner; Thence West 60 ft. to
Corner; Thence South 60 ft. to Corner;
Thence East 3 ft. to Comer; Thence
South 60 ft. to Place of beginning and j
holding the same in fee simple and j
have ejected Plaintiffs therefrom and j
unlawfully withholds from Plaintiffs j
the possession thereof to Plaintiffs dam-
age in the sum of One Thousand Dol-
lars.
Plaintiffs further allege that defend-
ants ought not to have or maintain any
defense against them, because they say
that they now have and under whose
title they claim, had peaceable, contin-
uous and adverse possession of said
land and premises hereinabove men-
tioned, using and enjoying the same as
a homestead, and having a house on
said premises that covers the whole lot,
for a period of Ten Years, next before
the commencement of this suit. In
fact have had and held Peaceable and
Lawful possession for a period of more
than Twenty-five Years.
Wherefore Plaintiffs pray that Cita-
tion by Publication issue for all de-
fendants and upon a hearing hereof,
Plaintiffs have Judgement for the title
and possession of said land and premises
above described, and that the cloud
cast upon the title be removed and that
they be quieted In their title and for
costs of suit and for all other rights
and privileges as to the Court may
seem proper and right.
