County Court Docket Lists 97 New Cases For First Six Months Of 1974
The Texas Civil Judicial
Council has released figures on
the judicial activity for the
reporting period of
January-June 1974 on the
county, justice of the peace
and municipal courts of the
state.
An analysis of the statistics
gathered during this reporting
period indicates a very large
number of cases filed in these
courts, amounting to a
crushing burden for the judges
of these courts if the rule of
law and the principles of equal
justice under the law for all
citizens is to prevail in our
judicial system.
A special interim report of
the Texas Civil Judicial Council
released in Austin, shows that
97 new cases were filed in or
appealed to the county court
of Winkler County during the
first six months of 1974. This
total included 4 civil, 74
criminal and 19 probate cases.
All of the justices of the
peace in the county submitted
reports to the Civil , Judicial
Council for all or a part of the
January-June, 1974, period.
The statistics for these courts
show that a total of 434 cases
were filed, including 349
misdemeanor cases involving
traffic offenses, 61 non-traffic

Administration on Jan. 1
begins paying for the first time
dividends to about 600,000
Korean Conflict veterans who
carry “RS” and “W” prefixed
National Service Life Insurance
(NSLI) policies.
Jack Coker, VA Regional
Office Director, noted the
dividends will be paid on
anniversary dates of policies,
but pointed out they will be
small in comparison to those
normally paid on other policies
carried by veterans of World
Wars I and II. The dividends
were authorized last May under
PL 93-289.
VA mailed dividend option
selection forms in October
which allow acceptance of
dividends in cash, or leaving
them with the agency as a
dividend credit or dividend
deposit, both at interest.
Dividends also may be used
to pay insurance premiums in
advance, buy additional
paid-up insurance, or to reduce
debt on policy loans. Dividends
left on credit are used to
automatically pay premiums
should the policyholder fail to
do so.
Coker explained that the
amount of dividend a veteran
receives depends on the face
value of the policy, his age at
time policy was issued and the
number of months in force
during 1975 dividend year.
Veterans with “RS” and
“W” policies were urged to
complete dividend option
selection forms and mail them
or inquiries to the VA
insurance center which
maintains the veteran’s
insurance records. Centers are
located in St. Paul, Minn., and
Philadelphia, Cpker added.

Statewide there are 254
constitutional county courts,
70 county courts at law, 934
justice of the peace courts, and
over 1,000 municipal courts.
While all of the 68 active
statutory county court at law
judges are licensed attorneys,
184 of the judges of the 254
constitutional county courts
are not attorneys; of the 934
justices of the peace
approximately 6% are
attorneys; and of the reporting
215 municipal court judges
(located in cities with a
population of 5,000 or greater)
approximately 65% are
licensed attorneys.
During the six-month
period, a total of 1,716,697
cases of all types within the
jurisdictions of the courts were
filed in or appealed to the
reporting courts and during
this same period these courts
disposed of a total of
1,539,931 cases. Of major
significance in the disposal of
these cases is that 53% of the
county court criminal cases
and 38% of the civil cases were
dismissed or settled prior to
trial. In the reporting justice of
the peace courts, 3% of the
traffic cases, 12% of the
criminal non-traffic cases, and
17% of the civil cases were
dismissed or settled prior to
trial. The reporting municipal
courts dismissed 18% of the
traffic cases and 15% of the
non-traffic misdemeanor cases
prior to trial.
Of the criminal cases tried in
county courts, the defendant
was convicted in 99.4% of the
cases and acquitted in 0.6%.
During this period 313
defendants were acquitted,
compared to 51,120 convicted.
This high rate of convictions
should be viewed in
relationship to the high rate of
dismissals prior to trial in these
same courts to obtain a true
conviction/acquittal ratio in
the county courts.
The reporting justice of the
peace and municipal courts
received $26,454,141 in
revenue during the six-month
reporting period, which funds
were deposited in the treasury
of the respective city or county
served by the courts, except
for a $2.50 court cost per case
which was remitted to the state
Criminal Justice Planning
Fund.
Some 137,875 new cases
were originally filed in or
appealed to the county courts
from the municipal and justice
courts. Criminal., cases
constituted 70% of this case
load, civil cases 15%, probate
14%, and juvenile cases less
than 0.5%. (Most juvenile cases
are filed in either the district
courts or in specialized juvenile
courts since by statutory
provision all juvenile cases
must be heard by a
lawyer-judge.)
Traffic cases accounted for
76% of cases filed in the justice
of the peace courts during this
period.Non-traffic
misdemeanors accounted for
12%, and civil cases, including
small claims, for another 12%.
Ninety-five per cent of the
traffic cases were disposed of
as a result of a guilty plea,
bond forfeiture, or payment
before trial. Disposition by
trial occurred in 2% of the
cases filed while 3% were
dismissed. Pleas of guilty, bond
forfeiture, or payment before
trial accounted for 81% of the
dispositions of* non-traffic
misdemeanors; trials were held
in 7% and 12% were dismissed.
In civil cases, 63% were
disposed of by agreement of
the parties prior to trial, 20%
were tried and 17% of the cases
were dismissed. There were
3,021 appeals filed from the
decisions of the justice of the
peace courts during this period.
A total of $9,265,904 was
collected by these courts.
In municipal courts, traffic
cases accounted for 84% of the
cases filed in this period, for a
total of over 858,000 traffic
cases. Non-traffic
misdemeanors provided the
remaining 16% of the new
cases filed as municipal courts
have no civil jurisdiction. These
courts reported disposing of
953,924 cases or 94% of the
1,023,110 cases filed during
the six-month period. Of the
traffic cases 74% were disposed
of as a result of guilty pleas,
bond forfeitures or payments
before trial; disposition by trial
occurred in 8% and 18% of the
cases were dismissed. Pleas of
guilty, bond forfeitures or
payments before trial resulted
in the disposition of 74% of
the non-traffic misdemeanors,
trials were held in 11% and
15% were dismissed. There
were 11,397 appeals filed from
the municipal courts during the
reporting period. A total of
$17,188,237 was collected by
these courts.
