Yesterday afternoon J. R. Ken-
nedy who ira» engaged in the gro-
cery and confectionery business at
Midlothian filed a chattel mortgage
In the county clerk's office for the
benefit of his creditor·. The liabil-
ities amount to $33β.40 and the as-
set* are estimated at t9U.22. W. H.
Massengale was named as trustee.

Changing Conditions.
F. M. Wearer returned from hi*
his ranch in the Territory yesterday
having just completed shipping 3500
head of cattle to Waxahachie and
Rockwall to be fed at the mills there.
Mr. Weaver say* this finishes his
stock in the Territory except a few
scattered head. Matters in that
section are very serious for the (ow-
men. The settlers are coming in
and taking the country and absorb-
ing the grass. Several Texas cat-
tlemen notably Burke Burnett
have w hat they need for grazing

I*. R. Thompson a substantial
farmer of Astonia returned to-day
from South Texa* where tie has

ton where it would take :jo or 40
arr»s to make a half. He further
stated that his crops were shorter

soon to he launched at that place.

application made to the comptroller
of the currency for authority to es-
tablish another national bank to tie

county injunction case is to be ar-
gued today before Judjre Diliard at
McKinney. Tom Whipple i- rep-
resenting the anti side of the matter
and judge Μ. Β. Templeton repre-
sent* the pro side. A very promi-
nent Ellis county lawyer who is an
anti says he was asked to assist
Whipple in the ease but after a
careful study of the apppllcation he
decided that the grounds wi re not
sufficient ami he declined the prop-
osition.—Ennis News.
The party referred to is a prom-
inent attorney and well known eit-
iiseu of Waxahachie and the above
statement is substantially correct.
