6 SPECIAL LAWS.
posited the county shall have the right to enter upon and use such
material and land. If the owner of such material or land or said county
is not satisfied with the compensation awarded such owner, he or said
county may appeal therefrom, as in case of appeals in proceedings by
railway companies to condemn right of way.
SEC. 12. In addition to superintending all the public roads in his
commissioners' precinct each commissioner shall personally oversee the
road hands or road crews and direct the work on each section of public
rod in said commissioners' precinct, and he shall require each hand
under his supervision to make oath to him in writing without cost the
exact number of hours of work performed on said road each day before
giving credit or remuneration to said hand. Each commissioner as
overseer of the road hands or road crews of his commissioners' precinct
shall make oath to the county judge, which shall be spread on the minutes
of the commissioner's court that each and every hand under his
supervision was engaged at actual work on said road or roads, the nunlber
of hours or days for which said credit or remuneration is claimed,
and that he, the commissicrnr, personally supervised and directed the
road work foi eight hours each day or any fractional part thereof for
which the claim is made, and that after approval by the commissioners
court each commissioner for services as road overseer shall receive for
his services any sum not exceeding three dollars per day. If either commissioner
fails. or refuses to comply with this section he shall be guilty
of a misdemeanor and upon conviction shall be fined in any sum not exceeding
$50.00 (Fifty Dollars).
If it becomes necessary, the commissioner of each precinct may appoint
one or more deputies whose duty shall be the same as that of the
commissioner, except that he or they shall make oath to the commissioner
instead of the county judge. No part of this Act shall deprive the commissioners
the right of contract, and it shall be the privilege of the commissioners
to contract according to the terms of this Act, and the commissioners
may be allowed for letting and receiving each contract three
dollars, provided he does not receive more than three dollars for any
one day's service.
The county commissioner shall require each contractor in road and
bridge work to make oath to him in writing the number of days and partof
days worked by himself and his employees on any contract before full
payment for same is made.
The road commissioner as superintendent of the public roads is hereby
given the authority by this Act and it is made his official duty to administer
oaths to his employees and to require his deputies to do the
same from their employees without cost.
SEC. 13. It shall be unlawful for any person to obstruct, alter or
divert or change the natural flow of rainfall or other surface waters on
or across anv land, where such obstruction, alteration, diversion or
change will directly or indirectly cause the flow of such waters on, to,
across or against any public road where it would not naturally flow;
and it shall be unlawful for any person to so obstruct, alter, divert or
change the natural flow of rainfall or other surface water on or across
any land where such obstruction, alteration, diversion, or change will
retain such waters on or along such public road, or prevent such waters
from easily and quickly draining away from such roads, or filling up
