Monday, March 10, A. I). 1952, there
came on and was held in the City of
Rocksprings, Texas, at the Courthouse
thereof, a Regular term of the Honor-
able Commissioners’ Court of Ed-
wards County, Texa-. The following
were present: The Honorable H. W.
Bierschwale, Judge Presiding; W. E.
Thurman, Sr.. Commissioner Precinct
No. 1: Joe \V. Wood. Commissioner
Precinct No. 2; X. K. Varga, Com-
missioner Precinct No. 3: Joe Carl
Hyde, Commissioner Precinct No. 4;
K. 1. Miller, Clerk, County Court,
and Dor W. Brown. Sheriff; all of
Edwards County, Texas.

THE STATE OF TEXAS,
COUNTY OF EDW ARDS.
On this the 10th day of March 1952,
the Commissioners’ Court met in re-
gular session at the regular meeting
place thereof in the Court House of
said County in the City of Rock-
springs, with the following members
being present:
Honorable H. W. Bierschwale, Coun-
ty Judge, W. E. Thurman. Sr., Com-
missioner Precinct No. 1, Joe W.
Wood, Commissioner Precinct No. 2,
X. E. Varga, Commissioner Precinct
No. 3. Joe Car! Hyde. Commissioner
Precinct No. 4, and E. I. Miller, Coun-
ty Clerk, and the following proceed-
ing.-, among others, were had. to-wit:
WHEREAS, there came on to he
heard and considered a petition sign-
ed by W. W. Sherrill and 108 other
persons who are qualified voters of
Edwards Countv, Texas, petitioning
the Commissioners’ 'Court to order
an elccction to he held in and thru-
out -aid County to determine whether
or not Edwards County shall adopt
the provisions of Chapter 178, Acts
1947. 50th Legislature of the State
of Texas, known as "The Optional
County Road Law of 1047," and
WHEREAS, this Commissioners’
Court has inquired into and affirma-
tively finds that said petition is signed
by a number of the qualified voters of
Edwards Count'’. Texas, exceeding
10% of the number voting for Gov-
ernor at the last preceding general
election held in such county, and that
said petition is otherwise ill confor-
mity with law: and
YVHERKAS. upon consideration of
the aforesaid petition it is the desire of
this Commissioners’ Court to cal! an
election to determine whether or not
said County -hall adopt the provis-
ions of "The Optional County Road
Law of 1947" as set forth in said pe-
tition :
Now, therefore, he it ordered, ad-
judged and decreed by the Commis-
sioners’ Court of Edwards Countv,
Texas:
That an election he held in and
throughout Edwards County, Texas, on
the 26th day of April, 1952, the same
being the last Saturday in said month,
at which election the following pro-
position shall he submitted to the
qualified voters of said County for
their action thereon:
Proposition
Shall Edwards County, Texas, adopt
by the provisions of the act known at
Optional County Road Law of
>9*7 as provided in Article 6716-1 of
the Civil Statutes of Texas, for the
construction and maintenance of Coun-
ty Roads and the administration of
the Countv Road Department on the
basis of the county as a whole with-
out regard to Commissioners Pre-
cincts?

That all qualified voters desiring to
support said proposition set forth above
shall have written or printed on their
ballots the words:
•FOR THE OPTIONAL COUN-
TY ROAD LAW OF 1947”
and those opposed shall have written
or printed on their ballots the words:
“AGAINST THE OPTIONAL
COUNTY ROAD LAW OF 1947".

That the said election shall he held
in all the regular voting precincts and
at the usual voting places in -aid
county and the persons heretofore ap-
pointed officers for elections in Ed-
wards County Texas, by this Commis-
soiners’ Court on March 11. 1952.
by order of record in Volume 7, page-
312 of the Minutes of the Commis-
sioners’ Court of said County, shall
hold said election within their respec-
tive voting precincts, and the County
Judge shall fifteen (15) days before
said election notify each presiding jud-
ge in writing of his duty to hold said
election, as provided by law.
IV.
That the manner of holding said
election shall he governed by the gen-
eral laws of the State of Texas regu-
lating general elections except as modi-
fied hereby.
V.
That a substantial copy of this el-
ection order shall serve as proper no-
tice of said election.
VI.
That notice of said election shall he
given by posting a substantial copy of
this order at a public place til each
voting precinct twenty (20) days be-
fore the election.

order was passed by the following

seconded by Joe Car! Hyde, it is or-
dered by the Court that the appoint-
ment of C. C. Higginbotham as Depu-
ty Sheriff of Edwards County. Texas,
as of the 18th. day of February, 1952.
and the appointment of Mrs. Evelynne
C. Martin, as Deputy County and Dis-
trict Clerk of Edwards County, Texas,
as of the 3rd. day of March, 1952, is
herenow in all respects approved by
the Court.
On motion of W. F.. Thurman, Sr.,
seconded by N. E. Varga, it is ord-
ered by the Court that the Countv
purchase front C. C. Higg'nbo.ham
the electric welding machine belong-
ing to him: for the total sum of
§1,000, payable as follows: Five hund-
red dollars cash and a like amount
on May 1st, 1952; the said §1,000 to
be charged equally to precincts 1,
3 and 4.
The foregoing iqinutes on pages
310-322, having been read in open
court are herenow in all respects or-
dered approved by the Court.
No further business appearing, it <s
ordered that this Court do herenow
adjourn this the 11th day of March,
