Be it remembered that on this day,
Monday, March 20th, A. D. 1939,
there came and was held in the town
of Rocksprings, Texas, at the Court members of said Court are present, a

the Commissioners’ Court of Edwards
County, Texas, convened in regular
session at a special term of said Court,
with the following members thereof
being present, namely:
J. E. Johnson, County Judge; J. S.
Brown, Commissioner Precinct No. 1;
J. C. Pope, Commissioner Precinct
No. 2; W. A. Chapman, Commission-
er Precinct No. 3; C. V. Whitworth,
Commissioner Precinct No. 4 and E.
I. Miller, County Clerk, the following
proceedings, among others, were had,
to-wit:
WHEREAS, heretofore on the 13th

is hereby SPECIALLY made, which
levied the necessary tax to pay the
current interest on, and to provide a
sinking fund sufficient to pay the prin-
cipal at maturity on the issue of refud-
ing bonds herein authorized; and
WHEREAS, this Commissioners’
Court again affirmatively finds that
Notice of Intention of the Commmis
sioners’ Court to pass the order .au-
thorizing the issuance of such refund-
ing bonds was duly given by publi-
cation in the “TEXAS MOHAIR
WEEKLY,” a newspaper published in,
and of general circulation in, Edwards
County, Texas, said Notice being pub
lished in said paper on the follow-
ing dates, to-wit:
February 17th and 24th, and March
3rd and 10th, 1939. The date of the
first publication thereof being at least
thirty (30) days before the meeting
of the Commissioners’ Court to be
held on this, the 20th day of March,
1939, at which time the proposed re-
funding order was to be passed; and
this Commissioners’ Court further af-
firmatively finds that such Notice of

WHEREAS, it appears affirmative-
ly to the Court that at the ‘time of the
authorization of incurring the above
mentioned indebtedness, there was
levied the proper tax in payment
thereof; and
WHEREAS, after levying the tax
to pay the principal and interest on
said refunding bonds, and after mak
ing provisions for all other fixe<
charges against the County this Court
affirmatively finds that sufficient tax-
ing power will remain to pay the op-
erating expenses of the County charge-
able to Said fund; and
WHEREAS, this Court further af-
firmatively finds that the maturities
of the refunding bonds hereinafter set
forth will be to the best interest and
advantage of said County, when taken
into consideration with other out-
standing indebtedness of said County,
the same will make the burden of taxr
ation to the best interest of said Coun-
ty of Edwards, and to the taxpayers

by the Commissioners’ Court of Ed-
wards County, Texas, to be to the best

BE IT ORDAINED, ADJUDGED
AND DECREED BY THE COM-
MISSIONERS’ COURT OF ED-
WARDS COUNTY, TEXAS:
I—That the bonds of said Edwards
County, to be known as “EDWARDS
COUNTY ROAD AND BRIDGE
REFUNDING BONDS OF 1939,”
>e issued on the faith and credit of
Edwards County, Texas, under and by
virtue of House Bill No. 312, being
Chapter 163, of the General Laws as
>assed by the Regular Session of the
42nd Legislature which became effec-
tive on May 21st, 1931, and by virtue
of the Constitution and laws of the
State of Texas, in the amount of Nine
Thousand and Six Hundred Seventy-
five $(9,675.00) Dollars.
II— That said bonds are issued for
the purpose of refunding a like amount
of valid and subsisiting indebtedness
of Edwards County, chargeable again-
st the Road and Bridge Fund of said
County and issued subsequent to May
21st, 1931, consisting of certain inter-
est-bearing time warrants hereinabove
more particularly described.
III— That bonds shall be numbered
consecutively from one (1) to twenty
(20), both inclusive, and shall be of
the denomination of Five Hundred
($500.00) Dollars each, except Bond
No. 1, which shall be of the denomi-
nation of One Hundred Seventy-five
($175.00) Dollars, aggregating Nine
Thousand Six Hundred Seventy-five
($9,675.00) Dollars.
IV— That said bonds shall be dat-
ed the 20th day of March, 1939, and
will become due and payable serial-
ly as follows:
April 10th, 1942, $175.00; 2 to 7 in-
clusive, April 10th, 1948, $3,000.00; 8
to 13 inclusive, April 10th, 1949, $3,-
000.00; 14 to 20 inclusive, April 10th,
1950, $3,500.00.
V— That said bonds shall bear inter-
est at the rate of five per cent (5%)
per annum, payable October 10th, 1939,
and semi-annually thereafter on the
10th day of April and 10th day of Oct-
ober of each 'year, and both principal
and interest shall be payable on pre-
sentation and surrender of bonds or
proper coupons in lawful money of the
United States of America at the First
State Bank, Rocksprings, Texas.
VI— That each of said bonds shall
be signed by the County Judge, coun-
tersigned by the County Clerk, and
registered by the County Treasurer,
and the seal of the Commissioners’
Court shall be impressed upon each of
them.
VII— That fac-simile signatures of
the County Judge and County Clerk
will be lithographed or printed on the
coupons attached to each of said bonds,
and shall be the same effect as if they
had been signed by them.
