AN ORDINANCE
Regulating the operation and use
of Taxicabs on the public streets
of the City of Oiney. providing
for licensing of chauffeurs, re-
pealing certain ordinances, pro-
viding for a penalty, and declar-
ing an emergency.
BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF
OLNEY, TEXAS:
Section I
Taxicab License, Fee and
Inspection
(A) By the term “Taxicab” as
used in this ordinance is meant
^ any and all vehicles carrying pas-
/ sengers for hire, except motor bus-
' es or motor coaches operated by
bus lines over designated routes
in and through said City.
(B) The term “Conduct a taxicab
"business” as used in this ordinance
& shall be held to mean the use of
one or more taxicabs within the
corporate limits of the City of Oi-
ney, by the owner thereof, for the
purpose of carrying passengers for
hire, either by driving the same
himself or having the same driven
by some other person, provided
that this definition shall not ap-
ply to any licensed chauffeur hired
1 as a driver by any person, firm or
^ corporation holding a permit to
conduct a taxicab business in the
City of Oiney.
(C) Before any person, firm or
corporation shall conduct a taxi-
's cab business in the City of Oiney,
he shall file with the City Secre-
tary of said City an application to
the City Council of said City for
a permit to conduct such business
in said City. The application shall
state the name and address of such
an applicant, whether the appli-
cant is an individual, firm or cor-
poration, and if a firm the name
and address of each member there-
of, and the number of vehicles
S w proposed to be operated under such
permit.
(D) If the applicant is an indi-
vidual, before any permit is grant-
ed it shall be made to appear that
he is a bona fide resident of the
City of Oiney; if a partnership,
then that the member of the firm
who will be in active charge and
control of the affairs of the part-
nership, is a bona fide resident of
said City; and if a corporation,
that the president, or other execu-
tive officer in active charge and
control of the affairs of the cor-
poration is a bona fide inhabitant
or resident of the City of Oiney.
(E) It shall be the duty of the
City 'Secretary, when an applica-
tion for permit is filed with him,
at the next regular meeting of the
City Council following the filing
of such application to call the at-
tention of the Council thereto; and
upon consideration of such applica-
tion, the City Council may grant or
refuse such permit, as in their dis-
cretion may seem to the best in-
terest of the citizenship of the
City of Oiney, and the public in
general.
(F) All permits for the conduct
of a taxicab business in the City
of Oiney, shall be issued and sign-
ed by the City Secretary of said
City and sealed with the seal of
his office; it shall be dated on the
day of its issuance; shall bear a
serial number; shall show the name
and address of the permittee; and
that the permittee has been author-
ized by the City Council of the
City of Oiney to conduct a taxi-
cab business in said City until the
expiration of the 31st day of De-
cember next following the date of
issuance; and that said permit is
subject to cancellation at any time
by the City Council.
IG) At the time of issuance of
a permit, the permittee shall pay
to the City Secretary of said City
the sum of $25.00 for the first ve-

hide; and if more than one vehi-
cle is proposed to be operated as
a taxicab, then $10.00 for each ad-
ditional vehicle. At the time of
the issuance of said permit, the
permittee shall file with the City
Secretary a statement in writing
under oath signed by him, showing
the number of vehicles proposed
to be operated by him, the make,
model, motor number, and state
license of each. If at any time the
holder of a taxicab permit shall
desire to use any additional vehi-
cles under the permit he may do
so only after he has made appli-
cation to the City Council for,
and has been granted by said
Council, a permit to use such ad-
ditional vehicles, and he shall furn-
ish to the City Secretary the same
information regarding such addi-
, itonal vehicles as is required in
1 this section regarding those cov-
ered by the original permit, and
shall pay to the City Secretary the
sum of $10.00 for each such addi-
tional vehicle.
(H) Every holder of a permit
granted under the terms of this
ordinance shall have and keep
painted in fast colors, contrasting
with color of vehicle, on each side
of each and every vehicle used by
him as a taxicab, the words: “Taxi
......Permit No.......,” filling the
blank with the figures denoting the
serial number of his permit. The
j letters and figures shall be not
(M) It shall be unlawful for the
holder of any permit issued under
the terms of this ordinance, or
the agent, servant or employee of
such permittee, to park or leave
standing any taxicab on the streets
of the City of Oiney, except while
loading and unloading passengers
into and from such taxicab.
(N) It shall hereafter be unlaw-
ful for any person conducting a
taxicab business in the City of
Oiney to use or operate, or cause
to be used or operated, as a taxi-
cab, any vehicle not owned by him.
(O) The word “person” and all
personal pronouns used herein
shall be held to apply to and in-
clude partnerships, firms and cor-
porations, as well as individuals.
(P) This ordinance shall not ap-
ply to passenger buses operating
under the regulations of the Rail-
road Commision of Texas, and com-
ing into or passing through the
City of Oiney, for the purpose of
loading and unloading passengers.
Section 2
Chauffeur's License
(A) From and after the passage
of this ordinance it shall be un-
lawful for any person to drive or
act as a chauffeur of a taxicab
within the City of Oiney, Texas,
without having secured a chauf-
feur’s license duly issued to said
person by the City Secretary of
the City of Oiney.
(B) Each and every applicant
(I) It shall hereafter be unlaw
I ful for any person, firm or corpor-
| ation holding a permit to conduct
i a taxicab business in the City of
I Oiney, to permit any person who
I does not hold a valid permit from
the City of Oiney as a taxicab
driver to drive or operate on the
public streets of the City of Oiney,
any taxicab owned or used in con-
nection with the business of the
permittee.
(J) Every holder of a permit to
conduct a taxicab business in the
City of Oiney, shall have each and
every taxicab used in his business
inspected once each month, and
shall file with the City Secretary
on or before the first day of each
and every month, a statement in
writing signed by a competent
resident mechanic showing that he
has inspected such vehicle, the
date of such inspection, the license
number of such vehicle or vehi-
cles, the name of the permittee
and the serial number of his per-
mit; and that the lights, brakes
and steering apparatus of all such
vehicles so inspected - by him are
in good mechanical condition.
(K) Any permit issued under
the provisions of this ordinance
shall be nonassignable, and may
be revoked by the City Council at
any time it shall appear to the
City Council that the permittee
has violated any provision of this
ordinance or failed to comply with
any requirement hereof.
(L) It shall hereafter be unlaw-
ful for any driver of any taxicab
to drive or cruise about on the
streets of the City of Oiney seeking

a citizen of the United States, and
shall be at least twenty-one years
of age, and shall be the owner
and holder of a di’iver’s license,
regularly issued by the Depart-
ment of Public Safety of the State
of Texas.
(C) Any person desiring to drive
or act- as chauffeur of a taxicab in
the City of Oiney, Texas, shall
file application for chauffeur’s li-
cense with the City Secretary at
the City Hall in said City on appli-
cation form to be furnished by
said City Secretary, and such ap-
plication shall be accompanied by |
a fee of $1.00 for such license,
said fee to be paid to the City
Secretary. Such application shall
be sworn to before a Notary Pub-
lic by said applicant and shall be
accompanied by an affidavit from
two reputable citizens of Oiney,
Texas, stating the applicaht to be
a trustworthy, sober and reliable
citizen.
(D) Upon receipt of such appli-
cation and fee and affidavit the
City Secretary shall issue a li-
cense to such applicant, which li-
cense shall expire on December
31, of thfe year in which same is
issued. Such license shall be car-
ried at all times by said chauffeur
while driving a taxicab in the city
limits of the City of Oiney, Texas,
and shall be displayed at any time
by such chauffeur upon request
of any citizen or customer patron-
izing such taxicab.
(E) It shall be a violation of
this ordinance for a person to drive
a taxicab in the -City of Oiney
Texas, without at the same time

ordinance for any person, firm or
corporation, or any agent thereof,
to employ or permit a person to
drive a taxicab owned by such
person, firm or corporation, who
does not have a valid and existing
chauffeur’s license of said City
for the current year.
Section 3
Penality
(A) Any person, firm, corpora-
tion, association or partnership
violating any provision of this or-
dinance shall b'e deemed guilty of
a misdemeanor, and upon convic-
tion thereof shall be punished by
a fine of npt less than $1.00 nor
more than $100.00, and each day
such violation continues shall con-
stitute a separate offense.
Section 4
Saving Clause
If any section or provision of
any section of this ordinance shall
be held to be void, ineffective or
unconstitutional such holding shall
not affect the validity of the re-
maining sections and provisions of
this ordinance.
Section 5
Ordinances Repealed
All ordinances or parts of ordi-
nances in conflict herewith shall
be and are hereby expressly re-
pealed, and particularly any and
all ordinances heretofore enacted
by the City Council of the City of
Oiney, Texas, affecting the opera-
tion of and licensing of taxicabs in
the City of Oiney, Texas.
Section 6
The fact that the operation of
taxicabs in the City of Oiney is
not sufficiently regulated by ex-
isting ordinances of said City, and
the further fact that the lives and
property of the citizens of said
City are and will be jeopardized
by reason of unlicensed operators
of taxicabs in said City, consti-
tutes an emergency, and for the
preservation of the safety of the
public at large this ordinance shall
be effective from and after the
date of its adoption.

and adopted this the 7th day of
August, A. D. 1945.
