I* TO 21 MONDAY
Tbt legal drinking age in Texas
will rise from II to 21 on Labor Day.
At 13:01 a.m. on Monday, Sept 1.,
powsaNon or consumption of
alcoholic beverages will be illegal
for any person who has not readied
Ms or her 21st. birthday. The only
exception is If the underaged person
is in the immediate physical
presence of his own parents or
spouse who is over 21. Possession of
an alcoholic beverage by the
underage person Is a misdemeanor
with a possible fine of $25 to $200.
It is also a crime for the underage
person to preeent false identification
or to misrepresent his age in an
attempt to purchase alcoholic
beverages or to successfully make
such a purchase even without
misrepresenting his age. In either
case, the first offense fine is the
same as for possession. Giving
alcohol to a minor carries a fine of
SlOOtofSOS.
A fine of 9100 toMM and/or
a year in Jail Is the penalty for the
first violation. A sscond violation
can result to the —me Jail term
and/or a fine of |M0 to $1,000.
The age change will affect persons
entering package stores. Liquor,
stores may not allow underage
persons to even enter the store and
most such establishments have
warning signs posted.
It is a criminal offense to ignore
the warning signs and enter a liquor
store.
Another common misconception is
that drinking age violations only
apply to public places. This is not
true as it is illegal in a house party, a
fraternity house, or a car parked on
private property.

Texas Mdory, one of the greatest
anomalies of recent years.
Since the mind of man runneth not
to the contrary, Texans have had a
deep seated hatred of bankers and
banking. As a result, we have had-
from time of the revolution against'
Mexico • some of the most
rsrtricthre hanking laws ever
written.
Indeed, at one point shortly after
statehood, former leaders of the
Republic of Texas who were close to
former President Andrew Jackson
tried to outlaw banks in Texas
entirely.
The various panics and
depressions of the rest of the 19th
and early 20th centuries merely
reinforced the plainsman’s
antipathy toward what he regarded
as the blood-sucking function of
banks. That is why today, among a
very few states, Texas still prohibits
a bank from doing business in more
than one place.
At least we say that is true. In

Chain banks are big - bigger than
anyone ever imagined they would
become when, some two decades
ago, state law was stretched to allow
them. They are now, however, as
vulnerable as they are Mg.
What has happened is that the
depression in oil, agriculture, and
real estate has compressed the
timetable of the inevitable: We have
several bank chains whose boom-
forever lending mentality now
Jeopardises their stockholders’
interests. The leaders of those banks
argue that only the ability to reach
across state lines with a “for sale”
sign can keep some of those holding
companies from taking the
bankruptcy gas.
The economic argument is that if a
multi-billion-dollar chain of hanks
goes in the tank, a lot of people
besides Just the stockholders will be
hurt badly; if several chains fall, it
will be a disaster for the entire state
because the chains reach into almost
every community in Texas.
Keep in mind, this probably was
going to happen anyway. A
combination of de-regulation and
other factors in the national
economy made interstate banking
as logical as Sears and Monkey
Wards or MasterCard. In Texas, in
fact, the bank holding companies
have been trying to get interstate
authority - only to be frustrated by
the opposition of independent
bankers.
A sub-plot now emerges. The
perceptive reader of business news
will realise that the record number
of bank failures in Texas so far this
year - a number that will Increase as
Christmas nears - is entirely an
independent-bank phenomenon.
That is, you haven’t seen a chain go
down the tube; it’s all been your
standard smallish, mostly rural
independent bank.
In the span of a month, though, the
Texas independent bankers’
iforaslinple
reason: If an interstate “for sale”
sign la good for the Mg beys, why
wouldnt it be good for the little guys,
too? That is, if a bank chain can sell
out to New York or Chicago or Los
have the same opportunity to make
money?
The froe-markat answer is to let it
happen. And yet that Just Mn’t
Texas history. It isn’t Texas lore
that a guy from Brooklyn can
KympetMxe with a tanner in
Hamilton, that a bank overlooking
Lnke Michigan talks like the folks in
Pleasanton, that Hollywood and
Fort Worth have more in common
than bull droppings.
But all of this is going to happen,
whether we like it or not and
whether we understand it or not.
