S.B. No. 616
1 Sec. 1702.372. RECUSAL OF COMMISSION [BGAR-] MEMBER.
2 (a) A commission [beae4] member who participated in the
3 investigation of a complaint of a violation of this chapter or in
4 informal settlement negotiations regarding the complaint:
5 (1) may not vote on the matter at a commission [b-ea-r-4]
6 meeting related to the complaint; and
7 (2) shall state at the meeting the reason for which the
8 member is prohibited from voting on the matter.
9 (b) A statement under Subsection (a)(2) shall be entered
10 into the minutes of the meeting.
11 SECTION 5.107. Section 1702.381(b), Occupations Code, is
12 amended to read as follows:
13 (b) A person who contracts with or employs a person who is
14 required to hold a license, r[gistratonendos ement,] or
15 security officer commission under this chapter knowing that the
16 person does not hold the required license[, rogltrtn,
17 endorsement-] or commission or who otherwise, at the time of
18 contract or employment, is in violation of this chapter may be19 assessed a civil penalty to be paid to the state in an amount not to
20 exceed $10,000 for each violation.
21 SECTION 5.108. Section 1702.386(a), Occupations Code, is
22 amended to read as follows:
