Rocky Point Man
Charged with
Murder Tuesday
Newton M. Denny-, 49. Rocky
Point oil field worker, is at lib-
erty under $5,000 bond after hav-
ing been charged with murder* of
his brother-in-law, Wilmer J.
Petty, about 29. The badly decom-
posed body' of a man identified as
Petty, was taken Monday' night
from the waters of Beaver Creek,
about 150 yards back of the 3-room
shack occupied by the Denny fam-
ily. Justice of Pej.ce J R. Carter,
was taken to the scene by Deputy
Sheriff Jack Green, to hold an in-
quest. Mr Carter declined to ren-
der a verdict until an autopsy was
performed. This was done, Tues-
day and the findings resulted in
the murder charge against Denny
who admitted to Justice Carter,
that he had a fight with Petty
Monday night, June 28, in the
Denny home and that about IL
o’clock that night, he pushed Pet-
ty outside the door of the Denny
home. That, Denny told Carter,
was the last time he had seen
Petty who had been staying with
Denny. He said they had been
'drinking. Denny, the father of six
children, said he and a neighbor
found Petty’s body floating face
down in about five feet of water,
after Petty’s brother, Carl Petty
of Wichita Falls had come to his
house Monday and reported that
Wilbur was missing.
The body was found about 6.45
p. m., Monday, July 5. Judge Car-
ter estimated it had been in the
water at least a week. The autop-
sy showed no trauma indicating
brain injury, no water in the
lungs indicating he did not drown.
Heart dilation indicated heart fail-
ure. The doctor’s oral report was
that the autopsy showed Petty
died of combination of shock and
exhaustion.
An Owens and Brumley ambul-
ance crew from Wichita Falls re-
moved the gruesome remains from
the water and took them to Wich-
ita Falls. Funeral services for
Petty were held at the graveside
in the Byers cemetery Tuesday
afternoon. His survivors include
his father, C. Petty of Wichita
Falls; mother, Mrs. Ava Petty,
Oklahoma City; a daughter, Mrs.
Patricia Ann Harrison, Wichita
Falls; two brothers, Carl and*Ern-
est Lee Petty of Wichia Falls. A
