The proposed surface mining will not approach nearer than 100 feet of the right-of-way line of any public road except as allowed by regulations or approved by the Commission. However, public road buffer zone variances are requested for the following
locations for the proposed permit term. Activities will include, but not be limited to, mining, pre-stripping activities, pond construction, diversion construction, road construction, dewatering activities, regrading, reseeding, erosion repair and other such
activities associated with normal mining, construction and reclamation procedures.
Through normal use, these roads will be maintained to control or prevent erosion, siltation and air pollution attendant to erosion; control or prevent damage to fish and wildlife resources; control or prevent contributions of suspended solids to stream flow or
runoff outside the permit area; neither cause or contribute to violations of State or Federal water quality standards applicable to receiving waters; not seriously alter the normal flow of water in streambeds or drainage channels; control or prevent damage to
public or private property; and non-acid or non- toxic-forming substances in road surfacing.
2. FM 2658 -The east side of FM 2658 0.40 miles from its intersection with the existing FM 1251 to a point approximately 2.5 miles north of the aforementioned intersection. The east side of FM 2658 3.5 miles from its intersection with the existing FM
1251 to a point approximately 1.5 miles north. The west side of FM 2658 0.40 miles from its intersection with FM 1251 to a point approximately 4.5 miles north of the aforementioned intersection.
If it is later determined that closures are required, approvals from the Rusk County Commissioners’ Court and the Texas Department of Transportation will be found in Appendix A of this permit application. Once roads have been closed, it is requested by
Luminant Mining Company LLC that the county roads be approved as temporary ancillary roads. County roads were designed and constructed under the specifications and supervision of the Rusk County Commissioners’ Court and satisfy the performance
standards of Section 12.400(b) of the regulations.

Surface Mining within 100 Feet of a Public Road
Lignite production will be accomplished with hydraulic excavators, hydraulic backhoes, front- end loaders, end-dump
trucks, haulers, scrapers, dozers and motor graders. Lignite recovered will be primarily transported by haulers to the
loading facility area. The mine blocks shown in the permit application represent mining and surface disturbances. See Life
of Mine Map in Section .125, Plate 125-1; Mine Plan & Operations Plan Maps in Section .139, Plates 139-1-1 through
139-1-3, and Table 119-1 located in Section .119.
Luminant proposes to disturb and conduct mining operations on property owned by Luminant Mining Company LLC and/
or on property where a valid coal and lignite lease exists. Luminant does not propose any surface disturbances or mining
operations on any property for which it does not have a valid right-of-entry. Information on the right-of-entry and property
ownership is detailed in Sections .116 and .117 of the permit application. The applicable tracts are shown on the “Property
Ownership” map located in Section .116 of the application on Plate 116-1.

The application is made pursuant to the Texas Surface Coal Mining and Reclamation Act, TEX. NAT. RES.
CODE ANN. Chapter 134 (Vernon Supp. 2017) and the Coal Mining Regulations,
This three (3) volume permit renewal application may be supplemented from time to time, with
supplemental or revised information (including revised maps, drawings and plates) placed in separate
volumes and filed for public inspection. Interested persons should contact the Administrative Law Judge or
continue to check the public copies of the application to determine the current status.
There are 27 proposed permanent water impoundments planned during the life of the mine (Section 139, Table 139(T)-8), including proposed pond (P-4) and its two associated diversions (P-4 Diversion Nos. 1 and 2) as seen on Plate 148-1 in Section .148.
The estimated percentages of the proposed postmine land uses, including alternative postmine land uses, are: pastureland,

to the general public and are listed as follows: general hydrology and geology of the permit area in Sections .126 and .127, respectively; water well inventory location map, Figure 128-3, Section .128; surface water information, Section .129; descriptions of
fish and wildlife, Section .133, and a protection plan is located in Section .144; soil resources information, Section .134; utility/pipeline relocations are shown on Plate 136-1 in Section .136; a request for a determination that there is no prime farmland located

Ownership of all affected lands in the proposed 3,866-acre Martin Lake Liberty Mine is described in Section
. 116 of the application. Copies of the application are on file with and available for public inspection at the
agencies and locations identified above.
This permit renewal application is presented as a “Permit Renewal by Reference” application, which means
it contains the updated and most current proposals for consideration and when combined with the original
15-volume permit application, it is considered the “complete” permit application. Both copies will be made
available to the public for inspection. The original Permit No. 58 has been administratively updated several
times since issued on December 11, 2012. The original permit application on file for public inspection
contains most of the administrative revisions, except for engineering structures, which are on file and
available at the Commission’s Austin office noted above.

Luminant Mining Company LLC (“Luminant”), 6555 Sierra Drive, Irving, Texas 75039 has submitted a
permit renewal application entitled Martin Lake Liberty Mine, Permit 58 Renewal/Revision
(“Application”), to the Railroad Commission of Texas Surface Mining and Reclamation Division
(“Commission”). A five-year permit renewal term is proposed by this application and consists of
approximately 3,866 acres. As depicted on the map included with this public notice, the Martin Lake
Liberty Mine is near the existing Martin Lake Mine, and is located along the western side of the Martin Lake
Reservoir approximately one (1) mile north of the intersection of LM 1251 and LM 2658, approximately
seven (7) miles southwest of Tatum, Texas and approximately nine (9) miles west of Beckville, Texas along
various property boundaries. The proposed permit area is contained within the “Eairplay” and “Tatum” U.S.
Geological Survey 7.5 minute, quadrangle maps.
