Court of Claims has written the
final chapter in the dramatic
story of an Air Force pilot whose
troubles began in earnest when
his plane plunged into the waters
of Lake Brownwood in West Tex-
as.
It was on Sept. 23. 1944, during
World War II. that Lt. Ernest F.
Boruski Jr. crashed. A West Point
graduate of the class of 1943, he
was stationed at Abilene Army Air
Base. His home was in Des Moines
Iowa, where his parents still live.
Although seriously injured, Bo-
ruski floated from the wreckage,
unconscious, and was rescued by
two boys who were rowing on the
lake. The body of his crew chief
passenger was found later when

Stephens County, Texas, on a
judgment rendered in said Court
on the 4th day oi August. 1958,
in favor oi Shirley Mae Haynes
and against Byron Haynes in the
case of Shirley Mae Haynes against
Byron Haynes No. 16.298 in such
court, I did on the 11th day of
October. 1958 at 2 o'clock P. M.
levy upon the following described
oil and gas leases on land situated
in Stephens County. Texas, as the
property of said Byron Haynes,
to-wit: an undivided one-half inte-
rest owned by him on April 28.
1967 in oil and gas lease dated
December 9. 1955 f.-om J. Earl
Rudder. Commissioner of the Gen-
eral Land Office of the State of
Texas. Lessor, to Eldorado Oil St
Gas. Inc. Lesseee, covering ap-
proximately 40 acres, described
as the most Westernly ',2 of Tract
No. 6 and most Easterly '2 of said
tract No. 6 to be an extension to
the North of the East line to the
center of the river bed. of T. E.
81 L. Co. Survey No. 491, and an
extension of the West line South
to the center of the river bed of
Survey No. 662. which is also the
East line of the McGaha tract im-
mediately to the North of this
lease: said lease being of record
in Vol. 286. page 154 deed records
of Stephens County, Texas, and
the same interest in the personal
property at and on said lease and
used in connection therewith. And
on the 4th day of November, 1958
being the first Tuesday of said
month, between the hours of 10
o'clock A. M. and 4 o'clock P. M.
of said day at the courthouse door
of said county. I will offer for
sale and sell at public auction for
cash all the right, title and interest
of said Byron Haynes in and to
said property.

he says, were discarded and some
ignored, but in the end he got his
message through.
On Aug. 28. 1951. the Judge Ad-
vocate General of the Air Puree
held that there had not been suffi-
cient evidence to substantiate a
conviction. The dishonorable dis-
missal was ordered replaced by an
honorable discharge.
That action was not enuugh to
satisfy Boruski. He telt he should
be given accumulated military pay
as though he had continued in ser-
vice up 10 the date of the honor-
able discharge. In fact, he contend-
ed he should receive increased pay
on the assumption that he would
have been promoted to captain on
June 1. 1945. and to major on Feb-
ruary 15. 1951.
When the military rejected Bo-
ruski's position regarding com-
pensation. he filed suit in the U. S.
Court of Claims. On Oct. 9. 1957,
after a long review of all circum-
stances in the case, the court in
a split decision agreed with Bo-
ruski. The majority held that the
Judge Advocate General "did not
have the authority to backdate (he
honorable discharge."
The Claims Court did not at the
time fix the amount of compen-
sation it thought Boruski should
be paid, but did say it should be at
the going scale ol a liei tenant for
entire period up tu the date ol
substitution of an honorable dis-
charge. on Aug. 28. 1951.
Now. almost exactly a year after
that Claims Court decision, and
specific amount has been determin-
ed and payment made.
On Sept. 2 the Court issued an
order directing the Treasury to
make the payment. Early in Oc-

When Bourski, a management
specialist now living with his wife
in New York City i209 Riverside
Drive. Apt. 9C>. recovered, he fac-
ed a court martial. On July 23.1945.
he was convicted and sentenced for
manslaughter and dishonorably-
discharged from the service.
The Court of Claims decision
noted that the court-martial came
up with "findings apparently in-
dicating that he was guilty of cul-
pable negligence in causing the ail
accident."
This is Boruski's own explanation
of what happened:
Piloting the plane 1 a twin engine
bomber 1 at an altitude of about
200 feet over Lake Brownwood, he
attempted to avoid a dark object
he presumed to be a bird. In push-
ing the control stick forward, his
head was snapped upward violently
against a metal reinforcement
gash and was knicked unconscious
With no one flying the aircraft, it
went into a dive and cut through
two wires connecting a tower lo-
cated on shore.
Boruski stated that squadron
directives were to the effect that
a part of every flight was to be
flown at tree top level or lower
as necessary combat training for
Italian theater. A prosecution wit-
ness said orders from a headquar-
ters base in Colorado were that
such flights should not be below
500 feet.
Upon conviction. Boruski began
a comeback battle which has just
ended, now
13 years later. ' tober Boruski received a $19,901.44
He dug up additional evidence I check.

all that twirling.
One of the 45 prize seekers in
a recent contest kept up a lively-
patter from the minute she began
whirling her golden hoop until she
was a goner two and a half hours
later.
Tyler's spokesman for the na-
tion's circular craze was Theresa
Edwards, a 10 - year-old. freckle-
faced redhead.
An hour belore she hoop-de-dood
out of the rontest. a ntnning five-
minute record of her hoop-isms
was recorder for the official refer-
ence work someone will eventually
write and entitle "The Hula Hoop:
Its Place in History."
To wit:
1:15 p. m.—"I'm dying."
1:20 i). m.—"I'm killing myself."
1:25 p. m. "I'm out of breath."
1:30 p. m.—"A new burst of en-
ergy from a soft drink produced.
"This is tun".
1:35 p. in.—"I'm starving."
1:40 p. m.—"I'm tired, tired, tir-
ed."
1:45 p. m. "I'm starving."
Some good Samaritan finally got
Theresa's message about her hung-
er pangs rutting a swath across her
stomach just like the hula hoop had
been doin? for thousands of times.
He yavc her another soft drink and
another generous spectator threw
in a bag of corn chips for good
measure. Theresa sipped and
munched, never losing what one im-
pressed spectator pointed out was
"definitely The movement.
1:50 p. m.—"I thought that was
gum* I stepped on."
1:55 p. m.—Here Theresa whirl-
ed into trquble. Somehow her hoop
slipped picariously below her knees.
This unfortunate turn of events
provoked her shortest statement:
"Whew!"
2 p. m.—"I'm a goner" was her
breathless comment as derlvish ef-
forts to get the boon back up to
her hips or waistline failed.
2:05 p. m.—"I'm itching" cer-
tainly didn't help mattera.
