Matagorda County -GREETING:
You are hereby commanded,- that
you summon, by making publication
of this citation in some newspaper
published in the county ot Matagorda,
it there be a newspaper published
therein, but if not, then in a news-
paper published In the nearest county
to said Matagorda County, lor four
consecutive week- previous to the re-
turn day hereof, Laura G. Hanks and
husband AV. II. Hanks, whose resi-
dence is unknown, to be and appear
before the Hon. District Court, at the
next regular term thereof, to he Itold-
en in the county of Matagorda at the
court house thereof, in Bay City,
Texas, on the first Monday in Jan-
uary. A D. 1923, being the 1st day
ot January A. I). 1923, then and there
to answer a petition filed in said
court, on the 14th day of March. A. D.
1919, in a suit numbered on the
docket of said court No. (1035, wherein
V. L. LeTulle Is plaintiff and Laura
G. Hanks and AV. B. Hanks are de-
fendants. The nature of the plain-
tiff':: demand being as follows, t<5-
wlt Suit upon vendor's lien dotes
and foreclosure, of vendor’s* lien upon
the following described property sit-
uated in the city of Bay City, Mata-
gorda County. State of Texas, to-wlt:
The west one-half of lot No. 12, In
block No. 134, city of Bay City, Texas.
Plaintiff further alleging that defen-
dants on .March 21, 1913, made, exe-
cuted and delivered to plaintiff their
three (3) several promissory notes,
each bearing date on the day and
year aforesaid; one of said notes lie?
Ing for sum of three hundred ($300.00)
dollars, and due one year from date,
and two of said notes being for the
sum of four hundred ($400.00) dol-
lars eaeli and due on the 21st day of
March, 1915, and 1916, each, respect-
ively. payable to the order of plain-
tiff, bearing interest at the rate of 8
per cent per annum from date until
paid, and the customary 10 per cent
or. the principal and interest due as
attorney’s fees. That said three
notes aggregating the sum of 11100.00,
were executed at Buy City, Texas, liy
aid defendants to said plaintiff for
a part of the purchase money of the
hereinbefore described real estate
and premises. That said property
wa on March 21, 1913, conveyed by
plaintiff to defendants by deed of
that date and that in said deed a lien
wa reserved thereon to secure the
payment of said notes; that said notes
an- due and unpaid, and though often
demanded defendants have failed and
refused to pay said notes or any or
any part of same. That said notes
have been placed in the hands of
Conger tn Davant, practicing attor-
neys at Bay City, Texas, and plaintiff
has contracted with them to pay them
