GOX INDICTMENTS
QUASHED BY COUBT
Cincinnati Political Leader
Wins Indictments Are
Found Defective.
Cincinnati O. May 20. Motions to'
quash the perjury indictments against
George B. Cox banker and Republican
political leader made oy his attorneys
two weeks ago. were granted by the
common pleas court
The indictments were found defective
in substance this phase of the decision
operating to free Cox not only from
the indictments in question but also
from reindictments on the same 'set of
alleged facts hy any subsequent grand
jury. ?
Cox was' Indicted February 21 and
his case has been rought before 15 1
judges of the common pleas circuit and-
supreme courts-of "Ohio the battle of
technicalities starting when Cox charg-
ing prejudice swore off the bench
judge Frank Gorman of the criminal
bench of the court of common pleas
The indictments charged that in tes-
tifying before the grand jury in 1906
Cox declared he had received no money
paid by various banks to ' the county
treasurer a "gratuities' for deposits of
county funds the erstence of these
gratuities having been "nrougnt out by
a legislative Investigating committee The
grand jury in January 1911 however
charged that it had information that
he did receive interest money from. two
different treasurers amounting in all
to $66000.
The court holds that In calling Cox j
before the erand Jury in 1906 and com- !
pelllng him to testify and then Indict- I
lng him for perjury because of that tes-
timony there was a violation of- his
