To the sheriff or any constable of
Cameron county greeting:
Y'ou aid hereby commanded to sum-
mon Peter Long whose residence is
unknown to be and appear at the next
regular teim of the District Court of
Cameron County T xas. to be held at
the court house ther. >f in the City of
Brownsville on (lie 4th Monday in May
192!* being the 25th day of May 1925
then and there to answer a petition
filed in said court on the 11th day of
March. 1925 in. a suit numbered GIT?
on the docket thereof wherein Michael
Sehawrtz is plaintiff and Peter Long Is
defendant.
Plaintiff’s cause of action being alleg-
ed in substance as follows:
That plaintiff resides in DuPage
County Illinois; that the residence of
Peter Long is unknown; That on the
20th day of March. 1920 the said Peter
Long made executed and delivered to

dated March 20 1920^ for the sum of
$2250.40. due on or before one year af-
ter date bearing interest from date at
the rate of 6% per annum payable
■ *etui-annually and that in order to se-.
j cure the payment of said note the said
I Peter Long made executed and deliver-
ed to John W. Egennann of DuPage
County Illinois a mortgage in writing
on the east half at Block 180 contain-
ing 20 acres of land more or less out
of the J. S. de la Garza Grant in Cam-
eron County. Texas known as the Fs-
piritu Santo Gnmt as shown on the
map of lands of San Benito Irrigation
Company and others of Share No. 1 or
said Espiritu Santo Grant of record in
the Deed Records of Cameron County.
Texas excepting however that part of
said land which is or may be used by
the canal company as an irrigation lat-
eral or canal this reservation being
seventy feet on each side of the center
line of said lateral or canal. It further
provides in said mortgage that upon the
filing of any bill or complaint or suit
of foreclosure on said above mentioned
1 note and mortgage all costs shall be
paid by the maker thereof including a
solicitor’s fee of $1-50.00 which costs
i»nd fees should be a lien on the land.
Plaintiff further alleges that no part of
said note has ever been paid and no in-
terest thereon and it has become ne-
cessary to institute this suit to fore-
close said mortgage and that same has
•been instituted by the filing of a pe-
tition in the District Court of Cam-
eron County. Texas; that plaintiff lias
•contracted to pay Seabury. George &
Taylor a firm of lawyers of Browns-
ville. Texas said solicitor’s fee ot
$150.00 which plaintiff alleges to be
reasonable. Plaintiff further alleges
that hv reason of the premises above
recited defendant became liable and
promised to pay said note the interest
thereon and the solicitor’s fee o‘
$150.00 and all costs of suit and that
to secure the same bv the terms of said
mortgage he has a lien upon said above
described land and he sues to establish
said debt interest solicitor’s fee and
costs and have the amount determined
and to foreclose his lien upon said
above described real estate and have
the same sold to secured all of said
liens and he further sues for a per-
sonal judgment against said defendant
should he appear in person.
Plaintiff prays for citation to de-
fendant by publication in terms of the j
law and for the establishment of his I
debt and foreclosure of his lien on said j
land as above recited and for the sale \
of the same to secure said amount and I
for an order of sale commanding the i
sale of said land for said purpose. an4 j
for a personal judgment against the de-
fendant should he appear in person and
for all other relief general and spe.

to serve this citation by making publi-
cation of the same once each week for I
