pany will perform the loading and unloading of cars as it has' contracted to
do with the railroads.

Remember, the Port of Galveston will be kept open, we hope by local
labor. We, therefore, ask you men to return to your jobs as you are not on
strike.
Due to the strike of longshoremen along our waterfront, many of our
railroad car unloading employes have been intimidated, although they have
no part in the loading of vessels, are not on strike and are entirely satisfied
with their wage scale and working conditions.

differences by a majority vote. If the
committee is unable to agree they will
name a seventh member by a majority
vote.
In case the committee can not agree
on the seventh member each party
shall submit the names of candidates
to George M. Harrison, president of
the Brotherhood of Railway Clerks,
who arranged the settlement in the
role of mediator, until both parties
submit the name of the same individ-
ual. Then Mr. Harrison is authorized
to appoint that person as the impar-
tial or seventh member of the com-
mittee.
New Convention Will Ratify
Agreement.
The committee was instructed to
reach an agreement not later than 30
days from Oct. 14. The findings of the
committee wil be final and binding on
all parties to the controversy and will
be submitted to a convention of the
19 building trades unions for ratifica-
tion. Pending the action of the con-
vention neither of the building trades
groups will be recognized by the
American Federation of Labor as the
Building Trades Department.
‘‘After the conclusion of the conven-
tion,” the agreement declares, “the of-
ficers of the department will notify
the president of the American Federa-
tion of Labor of the action of the
convention, at which time the unified

Greeting:
Oath therefor having- been made as
required by law, you are hereby com-
manded that, by making publication of
this citation in some newspaper pub-
lished in said County once a week for
four consecutive weeks previous to the
return day hereof, you summon Fred
J. Harrison, A. W. Boyd, Ross Gross-
hart John D. Vail, D. Miller and E. H.
Kent, d. b. a. Kent Realty Company,
defendants, to be and apear before the
District Court, 56th Judicial District,
to beholden in and for the aforesaid
County of Galveston, at the Court
House thereof, in the City of Galves-
ton, at the next regular term in said
Court to-wit: on the first Monday in
December, 1935, then and there to an-
swer the petition of E. E. Moore, plain,
tiff filed in said court on the 1st day
of October, 1935, and numbered on the
docket of said Court 51077 against the
said Fred J. Harrison, A. .W.Boyd,
Ross Grosshart, John D. Vail, D. Mil-
ler and E. H. Kent, d. b. a. Kent Real-
ty Company, defendants, and alleging,
iii substance, as follows:
That the plaintiff and those whose
title he holds have had peaceful and
adverse possession of the following
lands to-wit:
(a) Subdivision J-K-L, in Lot 1,
Block 89 of the Angell-Runge Addi-
tion to the town of Arcadia, Galves-
ton County, Texas, as the same ap-
pears from the plat and subdivision o6

the County Clerk of Galveston County,
Texas in Book 91, pages 216 and 217
Records of Deeds, said land being
claimed by Fred J. Harrison.
(b) Subdivision G-H-I, in Lot 1,
Block 89- of the Angell-Runge Addi-
tion to the town of Arcadia, Galveston
County Texas, as the same appears
from the plat and subdivision of said
Addition of record in the office of the
County Clerk of Galveston County,
Texas, in book 91, pages 216 and 217
Records of Deeds, said land being
claimed by A. W. Boyd.
(c) Subdivision A-B-D-E in Lot 2,
Block 89, of the Angell-Runge Addi-
tion to the town of Arcadia,, Galves-
ton County, Texas, as the same appears
from the plat and subdivision of said
Addition of record in the office of the
County Clerk of Galveston County,
Texas, in Book 91, pages 216 and 217
Records of Deeds; also that certain
tract of parcel of land described as
follows: Beginning at the N. W. cor-
ner of Angell-Runge Addition to the
town of Arcadia, Galveston County,
Texas, as the same appears from the
plat and subdivision of said Addition
of record in the office of the County
Clerk of Galveston County, Texas, in
Book 91, pages 216 and 217 Records of
Deeds, thence in an Easterly direction
along the northerly boundary of said
Angell-Runge Addition a distance of
630 ft. to N. W. corner of subdivision
A, Lot 2, Block 89 of the Angell-Runge
Addition, thence in a Southerly direc-
tion to the S. W. corner of said Angell-
Runge Addition a distance of 1476 ft. to
point for corner, thence in a north
westerly direction a distance of 1585
ft. to place of beginning containing
11.50 acres more or less and said land
being in Bl. 94, of said Angell-Runge
Addition to the town of Arcadia, Gal-
veston County, Texas, as the same ap-
pears from the plat and subdivision of
said Addition of record in the office of
the County Clerk of Galveston County,
Texas, in Book 91, pages 216 and 217
Records of Deeds, all of said land be-
ing claimed by Ross Grosshart.
(d) Subdivision J of Lot 1, Block 85
of the Angell-Runge Addition to the
town of Arcadia, Galveston County,
Texas, as the same appears from the
plat and subdivision of said Addition
of Record in the office of the County
Clerk of Galveston County, Texas, in
Book 91, pages 216 and 217 Records of
Deeds, said land being claimed by John
D. Vail.
(e) All of Subdivision G and L, and
the South one-half of subdivisions H
and K, Lot 1, Block 85 of the Angell-
Runge Addition to the town of Ar-
cadia, Galveston County, Texas, as the
same appears from the plat and sub-
division of said Addition of Record in
the office of the County Clerk of Gal-
veston County, Texas, in Book 91, pages
216 and 217 Records of Deeds, said land
being claimed by D. Miller.
(f) North one-half of Subdivision H,
Lot 1, Block 85, of the Angell-Runge
Addition to the town of Arcadia, Gal-
veston County, Texas, as the same ap-
pears from the plat and subdivision of
said Addition of record in the office
of the County Clerk of Galveston Coun-
ty, Texas, in Book 91, pages 216 and
217 Records of Deeds, said land being
claimed by E. H. Kent, d. b. a. Kent
Realty Co.
That plaintiff and those whose title
he holds have cultivated, used and en-
joyed the lands hereinbefore described
for more than 10 years, during which
period, he and those whose title he
holds have had such lands actually in-
closed.
That all the defendants herein have
claimed or are claiming some right,
title, or interest in and to the above
described lands, which said claim is
adverse to the plaintiff herein and
constitutes a cloud on his title to said
lands.
Wherefore, premises considered,
plaintiff prays that defendants be cited
to apear and answer herein, and that
upon final hearing hereof, the cloud
cast upon the title to any and all lands
hereinbefore described by defendants
herein be forever removed, and that
plaintiff’s title in and to the aforesaid
lands be in all things quieted, and that
the plaintiff herein be decreed to be
the legal owner and entitled to pos-
session of the aforesaid lands and for
such other and further relief, in law
and in equity, to which he may be
justly- entitled and which the Hon-
orable Court shall deem meet and prop-
er, as is more fully set for in petition
on file in my office.
Herein fail not, but have you then
and there, before said Court, this writ,
with your return thereon, showing how
you have executed the same.
