- flat stone of the old wall on the
edge of the Old Orchard, had fully
made up his mind to dine on young
woodpeckers. All about him were
[he little feathered people who live
in the Old Orchard, all screaming
at him and calling him bad names.
He didn’t mind this in the least. In
the first place, he was used to it.
in the second place, he knew per-
fectly that bad names never yet
hurt anyone. The truth is, he had
soiled up there just to draw the
birds around him. You see, he is
so sharp that he knew that he would
be able to tell by the way they acted
when they saw him which ones had
babies in their homes, and which
had not. And sure enough he could.
He knew that the ones who appeared
the most worried at the sight of
him, who were the boldest and came
the nearest, were the ones who had
babies at home.
One of these was Goldie the Ori-
ole. “His nest is way up high and
out on the slender branches. It is
too much work and too risky to
climb way up there,” thought Mr.
Blacksnake.
Another was Chippy the Sparrow.
“His nest is not very high and it is
easy to get to, but his babies are
so small that they are hardly worth
while,” thought Mr. Blacksnake.

or any Constable of Galveston County,
Greeting:
Oath therefor having been made as re-
quired by law, you are hereby command-
ed that, by making publication of this
Citation in some newspaper published in
said County once a week for four con-
secutive weeks previous to the return day
hereof, you summon Effie Hollingsworth,
defendant, to be and appear before the
District Court, 10th Judicial District, to
be holden in and for the the aforesaid
County of Galveston, at the Court House
thereof; in the City of Galveston, Texas,
at the next regular term of said Court,
to.-wit: on the first'Monday in June, 1939,
then and there to answer the petition of
C. E. Hollingsworth, plaintiff, filed in
said Court on the 1st day of May, 1939,
and numbered on the docket of said
Court 55,130 against the said Effie Hol-
lingsworth, defendant, and alleging, in
substance, as follows:
That on or about the 15th day of April,
1936, the plaintiff and the defendant were
duly and legally married in the State of
Kansas, and lived together as husband
and wife for only a few days, when to
his surprise, upon his return from work
on or about the 25th day of April, 1936,
the defendant had left, taking with her
all of her belongings, and he has not
seen or heard of her since.
Plaintiff would represent to the Court
that he gave the defendant no cause or
provocation to act as she did, or to leave
him as she did; for the few days that
they lived together he treated her with
kindness and forebearance, and with love,
but notwithstanding his kind treatment
she abandoned him and they have not
met nor lived together since; there is no
community property nor were there any
children born to them. Plaintiff prays that
citation issue by publication, commanding
the defendant to appear and answer this
suit, and upon final hearing, plaintiff
prays the Court for a decrease of divorce
dissolving the bonds of matrimony exist-
ing between them, for costs of this suit,
for general relief, etc., as is more fully
set forth in the petition now on file in my
office.
Herein fail not, but have you then and
there, before said Court, this writ, with
your return thereon, showing how you
have executed the same.
Issued this the 1st day of May, A.D.
1939.

pubished in said County once a week
for four consecutive weeks previous to
the return day hereof, you summon

and of the heirs and legal represen-
tatives of said May Preston Slosson, if
she be dead,'and complaining of G.
W. Hindman, if living, and of the
heirs and legal representatives of the
said G. W. Hindman, if he be dead; and
complaining of H. Merlyn Christie, if
living, and of the heirs and legal rep-
resentatives of the said H. Merlyn
Christie, if he be dead; and complain-
ing of W. B. Slosson, if living and of
the heirs and legal representatives of
the said W. B. Slosson, if he be dead;
and complaining of the Walter Keeble

the 17th day of April 1939, and num-

Defendants, and alleging in substance
as follows: That on or about the 1st
day of January A. D. 1939, Plaintiff
was lawfully seized and possessed in
fee simple of all the’ following de-
scribed property, lying and being situ-
ated in the County of Galveston, State
of Texas, known, designated and de-
scribed as all of Lot Five Hundred
Seven (507), containing twenty (20)
acres of land in the Townsite of Ata
Loma according to the recorded plat
thereof. Plaintiff would show that foi
more than ten (10) years preceding and
prior to the institution of this suit, to-
wit: since the 27th day of September,
1928, Plaintiff and those under whom
he claims have had peaceable, adverse
possession of the property involved in
this cause, using, cultivating and en-
joying the same within the meaning of
the Statutes of Limitation of the State
of Texas, and Plaintiff still has full
title to the property sued for, preclud-
ing all claims of Defendants, Plaintiff
further represents that by reason of
the facts alleged in clause two (2) of
this petition, and under the same, this
Plaintiff is and was prior to the insti-
tution of this suit, the lawful owner
and possessor of the premises sued for
herein. That on the day and year here-
inabove mentioned the Defendants and
each of them unlawfully entered upon
the herein above described property
and premises and ejected Plaintiff
therefrom and unlawfully withholds
from Plaintiff the possession thereof,
to his damage in the sum of Five Hun-
dred ($500.00) Dollars.
Wherefore, Plaintiff prays for a de-
cree for the restitution, title and pos-
session of said property and premises
and for damages and for costs of suit
and for a writ or writs of possession
of said property and premises, and for
all such other and further relief, both
legal and equitable, to which he may
show himself entitled.
Herein fail not, but have you then
and there, before said Court, this writ,
with your return thereon, showing how
you have executed the same.

eating, so I believe I’ll sample them ,
right away,” thought Mr. Black-<
snake.
He lazily uncoiled and slipped of’
the stone wall. Then he glided swift- ■
ly through the grass, all the birds
following and anxiously watching to
see where he was going. All the
time they made a terrible racket.
Mr. Blacksnake paid not the least *
bit of attention to them. He made
straight for the tree in which was
the home of Drummer the Wood-;
pecker. When Drummer saw this
he became almost crazy. Twice he
dashed almost in the face of Mr.
Blacksnake. Mr. Blacksnake just
chuckled to himself, for he knew
now that there wasn’t the least doubt
about those babies. Mrs. Drummer,
who remained at home, now came
out, and she was even braver than
Drummer in trying to drive Mr.
Blacksnake away. Once he struck
at her and almost caught her.
But nothing that Drummer or
Mrs. Drummer could do changed
Mr. Blacksnake’s intention. He keptI
right on and began to climb the
tree. Now, some of Mr. Black-
snake’s relatives—in fact, most of
them—cannot climb, but he himself
is a very good climber, and it was
no work at all for him to get up to
the round hole which was the door-
way of Drummer’s home. As he

drew near he heard a sound that
made his eyes sparkle. You see,
the babies inside the hollow heard
him, and, being young and quite
innocent of the dangers of the Great
World, they thought it was their
mother, or father bringing them
something to eat, and so each be-
gan to call for the goody they
thought was being brought to them.
When Mr. Blacksnake reached the
doorway he coiled himself about a
branch so as not to lose, his balance,
and fall, and then he looked in at
the doorway.
“One, two, three, four, five,”
counted Mr. Blacksnake, and
smacked his lips.
“My, but I shall have a feast!
I’m so glad I happened to think to
come up to the Old Orchard.”
