and collection of all Taxes aue the City
Brownsxille for the years A. D.

WHEREAS There is a large amount
of Taxes due this the said Citv of
Brownsville from divers persons etc

WHEREAS By reason of the non-
payment of said taxes this the Citv of
Brownsville lias become greatly" in-
debted and is unable to pay its current
and necessary 'accruing expenses and
also by reason of which its city warrants-
or "scrip" have become greatly
depreciated in Value;' and
WHEREAS Said delinquent Tax
payers have many of them for many
years thus far failed or refused to pav
the said Taxes so due by them; and
WHEREAS No City Attorney of this
city has ever made any endeavor to by
law enforce the collection of said un-
paidtaxes;and WHEREAS The present City Attor-
ney has left the city for other and dis-
tant parts of the state in search of
other employment and it is not known
whether he will return by reason of all
of which it has become necessaay and
the interests of the city imperatively re-
quire that counsel be immediately em-
ployed to enforce the collection of such
unpaid Taxes;
THEREFORE Because of the prem-
ises BE IT ORDAINED by the City
Council of the City of Brownsville;
Section 1. That this the said City of
Brownsville has now employed and
does hereby in all things employ Jas.
B. Wells a practicing attorney of said
city as the attorney of this said city to
enforce the collection of and to collect
all the Taxes now due this the said
city for the years A.D. 18S5 18SG 1887
1888 1889 1890 1891 1S92 1S93 1894
1895 189G 1S97 189S 1899 and all such
taxes of year A. D. 1900 as may hereaf-
ter become due and be unpaid for the
period of sixty (GO) days after the time
when they are required by the ordin-
ances of this city to be paid;
Section 2. That the said Wells as
such attorney is to receive as his com-
pensation for his services in the in the
premises a commission of ten (10). per
cent on the amount of any and all such
taxes now so due and unpiad for each
and all of the several fifteen years
hereinbefore specially mentioned to
wit from A. D. 1S85 to A.D. 1899 both
years inclusive and also such taxes of
the 3ear A. D. 1900 as may hereafter
become due and be unpaid for the period
of sixty (60) clays after such time as
they are required by the Ordinances of
this city to be paid that may be paid
or collected as hereinafter provided in
this section : said compensation or com-
mission of ten (10) per cent to be com-
puted -upon become due to said Wells
from this the said city and be paid to
him by it out of aud upon all such
taxes and amounts thereof now due and
unpaid for each all and any of such
said sixteen (1G) j-ears as hereafter may
be paid to the collector of taxes of this
city or 'to said Wells as such attorney
for this city or collected by him by
suit or other legal proceeding had and
so paid to him at the tinift any of such
taxes may be so paid or collected and
whether any such suit or other legal
proceeding be brought or commenced
by him to enforce their collection or
not; and the said Wells is to receive no
other or further compensation in the
premises than the said ten (10)per cent
upon the amount of all such taxes of
and for the said sixteen years as may
be actually so paid collected &c as
hereinbefore provided;
Section 3. That the collector of taxes
and the secretary and the treasurer of
this city and each of them shall be.and
are now hereby directed and required
to at any and all times immediately
upon his request ruereco luraisu saiu
Wells as such attorney with all such
tax rolls delinquent lists reports or
copies of the same or any part thereof
or othci records or information in their
or fiither of their possession or knowl
edge as such oflicials as he may from
time to time require;
Section 4. That said Wells shall as
soon as reasonably practicable by verbal
or written notices to each of them or
bv a general notice published in the
"Brownsville Daily Herald" notity
all such Delinquent Tax .Payers as owe
any of said unpaid taxes to within
such reasonable time as he may fix iu
such notice or notices pay to himself
or the city tax collector all sucli taxes
as are due by them or in the event of
their failure to do o legal steps will
bo taken to enforce thoir payment and
he the said Wells as such attorney for
this city and the collector of taxes of
this city are hereby specially authoriz-
ed to remit and forego all interests and
costs and now due the city upon all
such delinquont taxes as shall be fully
paid to them or either of them before
suit or other legal proceeding be insti-
tuted or commenced to enforce their
collection;
Section 5. That said Wells as such
attorney of this city is now hereby in
all things fully authorized aud em-
powered in his discretion to in the
naino of and for this the said city of
Brownsville take any and all such steps
or proceedings institute any such suits
or suit sign any such petitions Jjjmds
aflidavitsr aud generally do any and all
such tilings in the premises as he may
deem necessary and best to secure the
resouably speedy payment or collection
of all such said taxes ;
Section 6. That the tax Collector and
Treasurer of this city are now hereby
instructed and ordered from this date
to" keep separate and distinct accounts
of all such delinquent taxes for erch
and all of the years hereinbefore men-
ticned that may at any time hereafter
be received by. or come into their hands j
respectively from any source; said ac-j
.couuts to show the date paid by
whom paid the year -for which
paid all of the property upon
which paid and the exact amounts in
money and city warrants or scrip."

date of registration aud their registra-
tion number; and it shall be the duty of
the tax collector and the treasurer re-
spectively and they and each of them
shall on or before the first day of each
current calendar month thereafter in
writing make and file with the secret-
ary of this city a full descriptive report
as hereinbefore mentioned of the said
delinquent tax accounts to be kept by
them of any and all such delinquent
taxes paid to or coming into their
hands respectively during said current
calendar month last past. Aud said
Wells shall also in all things keep
such full descriptive account of any
and all such delinquent taxes so collect-
ed or received by him from any source
and shall upon receiving any such said
tax pay the the same to the city tax
collector taking hisofficail receipt there-
for; Section 7. That inasmuch as said
Wells is now here present at this meet
ing of the City Council and now here
accepts said employment and assents to
the terms and provisions of this ordin-
ance as in all things creating fixing
and providing for his employment com-
satibn and duties in the premises this
' Ordinance shall be deemed the contract
of employment etc. of said Wells in
the premises and no further or other
; contract be necessary;
Section 8. That all ordinances or
! parts thereof in anywise in conflict
with this Ordinance be and the same
are now repealed ;
: Section 9. That this Ordinance take
effect and be iu full force from and af-
ter its passage.
Adopted iu open session of the City
Council bv a unanimous vote this the
31st. day of December A.D. 1900.
