The constitution, which divides
the work of the three branches of
government, winds up by telling
where the rest of the power rests
—just in case anybody gets any
fancy ideas of dictatorship. There
are things no state can do, for in-
stance, “make or enforce any law
which shall abridge the privileges
or immunities of citizens of the
United States.”
If there are any powers not giv-
en to the United States govern-
ment or reserved to the states,
they belong to the people. The
constitution does not seem to limit
the people.

4. Congress cannot tax exports
from any state nor by regulation
favor one state’s ports over an-
other’s, nor make one state’s ves-
sels clear or pay duties to another
state in order to enter.
Besides these denials from with-
in, the constitution curbs Congress
and the executive and judiciary in
the amendments, especially the
first ten.
Among other things, Congress
cannot make a law respecting es-
tablishment of religion or prohib-
iting its free exercise, or abridg-
ing the freedom of speech, of the
press, or the right of the people
peaceable to assembly and to pe-
tition the government for a red-
ress of grievances.
The constitution also curbs the
courts (for example, they cannot
deny a person a fair hearing duly
represented by counsel.) It curbs
the executive (he cannot, for ex-
ample, take private property for

than in the previous year. In the
present year spending will be some
$50,000,000 higher than in the
year just ended.
Biggest expenditures, in the or-
der of their cost, were for high-
ways, schools, public welfare, state
hospitals and penal institutions.

someone. Congress cannot by-
pass the courts.
The week of September 17-23
has been designated as “Constitu-
tion Week.” Each year an obser-
vance is scheduled throughout the
nation in recognition of the im-
portance of the federal constitu-
tion, which forms the basis of our
national government. It insures
a stable balance of powers be-
tween the legislative, executive
and judicial branches of govern-
ment by providing curbs upon the
authority of each.
For instance, mighty as our
Congress is, the Constitution does
not give it certain powers:
1. Neither Congress nor anybody
else can suspend the writ of hab-
eas corpus (unless the public safe-
ty demands it during rebellion or
invasion.) All officers or others
must obey a court and bring in
anyone in their custody to see
whether he is held lawfully.

ended. This is $140,000,000 more
Probably, for the first time at 1
least, long habit will cause most
candidates to feel this is too
early.
Also for the first time in 1960,;
county officials will face a new
fact of life. A constitutional ।
amendment adopted last year bars ;
them from running for another!
office while holding their present!
office, if it has more than one year
to run.
This means that district judges,
district attorneys, county judges, I
etc.., all of whom have four-year
terms, can’t run for some state of-
fice in their “off year.” They will
have to resign first. This rule
does not apply to state officials
holding four or six-year offices.

Texas government cost more
last year than ever before and will
cost even more in the fiscal year
that began this month. But there
was a bright spot in State Comp-
troller Robert Calvert’s report.
Because of a new bookkeeping
system enacted by the Legislature,
the General Revenue Fund deficit
is only $26,571,159 instead of the
$67,000,000 that was predicted.
Calvert reported the state spent
