the disposal of low-level radioactive waste (LLRW) at a Texas
facility.
a. REPEALOF PROHIBITIONAGAINST ACCEPTING OUT-OF-STATE
LOWLEVELBADIOACLIVEWASIE
Texas law no longer prohibits disposal of out-of-state
waste in Texas as long as three primary conditions are
satisfied: 1) the total volume of out-of-state waste may not
exceed 20% of the total produced in Texas over the 50 year
period ending 2045; 2) any compact partner is required to
"share the full cost of constructing" the disposal facility;
and 3) Texas retains full control over the management and
operation of the facility. The legislation also provides that
the language of any compact agreement will supercede the
particular requirements of the new law, and that the Texas
Authority may turn over facility operation to a private
operator such as Chem-Nuclear or U.S. Ecology (copy of law
attached).

b- BONDING AUTHORITY FOR THE TEXAS LLRW DISPOSAL AUTHORITY.
For the first time the Texas Authority received, authority to
issue bonds for financing the licensing and construction of a
disposal facility and to fund debt service on those bonds.
Previously the Texas Legislature had funded budgets for the
Texas Authority each year on a pay-as-you-go basis from that
state's General Fund. The new bonds will be revenue bonds
with repayments to be made from the income (from disposal
fees) of the facility once it operates.
