Q: We are planning to sell
our home. If we find a buyer
who wants to “assume” our
mortgage, instead of arrang*
ing for a new mortgage, could
our mortgage company come
back to us for payment of the
mortgage if the buyer cannot
make the monthly payments?
A: Yes. Any time you sell
your home by having some-
one assume the balance of
your mortgage, the mortgage
company retains the right to
look to you for the monthly
payments if the buyer fails to
meet them. To protect your-
self in a sale of this type, the
contract between you and the
buyer should be written to in-

resenting me in an estate
matter. Should I hire another
lawyer to investigate?
A: You should bring your
complaint before one of the
district grievance committees
of the State Bar of Texas. If
you do not know the name of
the chairman of the grievance
committee in your area, write
to the State Bar in Austin. It
will not be necessary for you
to have a lawyer to represent
you before the grievance com-
mittee.

copyright and Federal copy-
right laws. Before art works
are publicly displayed, the ar-
tist has absolute control.
Once art works are publicly
displayed, the artist must
comply with federalcopyright
laws which require that a
statutory copyright notice be
affixed to the art work, and a
copyright form be filed with
the United States Copyright
Office. The result of failure to
comply is that the artist loses
all control over reproduction
and sale of his work.
Q: I inherited several hun-
dred shares of stock from my
father. Is my husband’s per-
mission required for selling
this stock issued in my name?
A: No. Texas law no longer
gives the husband-full control
and management of a mar-
ried couple’s community
estate. A wife now has full
control and management of
her separate property and all
community property acquired
solely with the wife’s earn-
ings.
Q: I have a question as to
whether my lawyer did
something unethical in rep-
elude provisions allowing you
to have title to the home re- •
turned to you in the event the
buyer defaults; then, you
would resume responsibility
for paying off the mortgage.
Otherwise, the mortgage
company could sell the house
and look to you for any bal-
ance remaining on the mor-
tgage after proceeds of the
sale are applied against the
mortgage.
Q: How can I copyright
watercolors I have painted?
A: Artists cannot always -
prevent unauthorized repro-
duction and distribution of
their work. Their rights are
controlled by common law

Q: I bought a pair of boots
under a lay-away plan, but
am unable to complete the
payments. Can I demand a
refund of my payments made
so far?
A: No. There is no law
, requiring the merchant to
refund your payments on lay-
away purchases. You should
ask the merchant whether he
will make such a refund
before you begin making
payments. If the merchant
agrees and makes refunds,
this agreement should be
made in writing and a copy
retained by the consumer.

Q: When I opened my new
business, I was required to
post a surety bond of what I
considered to be a large
amount before I could be
issued a sales tax permit. A
friend of mine in a similar
business was required to post
a much smaller bond. Why
are bonding requirements
different?
A: The bond is required
under the Texas Sales Tax
law for all new retail
businesses. Normally, the
bond amount is equal to three
times the level of sales tax
that the merchant estimates
he will collect during three
months. If that estimate
proves too high or too low, his
bond will be adjusted up or
down to reflect his actual tax
collections level. This ad-
justment will be made by the
State Comptroller of Public
Accounts through the Comp-
troller’s field offices around
the state. If the new retail
merchant remits his sales tax
collections properly during a
two-year period, the bond
requirement can be removed.
