About five years ago the state
of Texas passed a law changing
th® mode of procedure in the
criminal jurisdiction and action
of cities and towns that did not
have a special charter from the
state. This made it necessary
that the city secretary be de
nominated as clerk of the cor-
poration court and the mayor as
ex-officio recorder and acting
judge.
Section 3 of said act of the
legislature provides that the
mayor of the city is eofcie
recorder if the beard of aider-
men provide by ordinance to act
as such. The law also provides
for the city secretary to be ex-
officio clerk of the corporation
court during his term of office.
In my opinion it would be best
for your honorable body to ap-
point the city secretary clerk of
the court for the balance

Indigestion Causes

“For several years I was troubled
with a weak back but more recently it
began to trcuble me severely. If I

Heretofore the city council
has provided for the officers as
above set forth the same com
pensation that the justice of the
peace is allowed under the state
law. I would recommend to
you that you pass by ordinance
the appointing of the city’ secre
tary as clerk of the corporation
court fer his unexpired term and
the appointing of myself as re
corder for the city of Decatur
for my term of office, and that
the compensation for the clerk
of the court and recorder be the
same as allowed by law to jus-
tice of the peace, and provide
that in no case shall the fees of
the officers of said court, includ-
ing the recorder and clerk of
court, be paid out of the city's
funds until same has been collect-
ed and placed in the hands of
the treasurer of the city of De-
catur. By this method the city
will never lose a dollar on ac-
count of the trial courts, bnt
