1 AN ACT 2 relating to the payment of child support to an individual with 3 actual primary possession of the child. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 156.409(a), Family Code, is amended to 6 read as follows: 7 (a) If the sole managing conservator of a child or the joint 8 managing conservator who has the exclusive right to determine the 9 primary residence of the child has voluntarily relinquished the 10 primary care and possession of the child to another person for at 11 least six months, the court shall, on the motion of a party or the 12 other person having physical possession of the child, [may] modify 13 an order providing for the support of the child to provide that the 14 other person having physical possession of the child shall have the 15 right to receive and give receipt for payments of support for the 16 child and to hold or disburse money for the benefit of the child. 17 SECTION 2. This Act takes effect immediately if it receives 18 a vote of two-thirds of all the members elected to each house, as 19 provided by Section 39, Article III, Texas Constitution. If this 20 Act does not receive the vote necessary for immediate effect, this 21 Act takes effect September 1, 2005.
