part hereof; that the County of
Galveston and State of Texas are
entitled to have the amount of said
taxes now due and to accrue recog-
nized in this proceeding and that
they recover the amount of said
taxes by virtue of the interest and

Said land is to be condemned and
acquired, by the County of Galves-
ton for the following purposes, to
wit:
Galveston County is exercising
the right and authority conferred by
virtue of the statutes specified in
petition and by virtue of Senate
Bill No. 247, adopted by the 40th
Legislature, Regular Session, Page
129 et seq., Acts of the 40th Legisla-
ture, as same may have been
amended, to acquire for the pur-
pose of navigation the tracts num-
bered (1) in this notice for and as
right of way for a canal authorized
to be improved, constructed and
maintained under an Act of the
United States Congress now in
force, said canal being known and
designated as “ INTRACOASTAL
CANAL” map or plat of which canal
right of way, including the land to
be used for dumping purposes is re-
corded in Volume 254, Page 121,
Galveston County Deed Records,
and to acquire for the purpose of
navigation and in aid thereof, the
tracts numbered (2) in this notice
to be used by the United States of
America for the deposit of dredged
materials and for such other inci-
dental purposes as may be needful
in the construction, preservation
and maintenance of said canal and
said canal right of way.
That the condemnation and ac-
quisition of said land is made nec-

feet in length, said strip of land
described by metes and bounds as

(1) Beginning at the northeast
of Engineers, U. S. Army, and duly
filed for record in the office of
County Clerk of Galveston County,
Texas, said map being recorded in
Volume 254, Page 121, Galveston
County Deed Records, the northerly
line of which is actually now staked
on the ground, said tract or parcel
of land being 300 feet wide except at
curves where it is slightly wider, as
shown on said map.
The County of Galveston and
State of Texas further allege that
they have an interest in and to the
property hereinafter referred to in-
volved in this proceeding in the
form of a lien for taxes to secure
the payment of the amounts regu-
larly assessed against the record
owners of said respective tracts, but
as yet unpaid, for the years herein-
