38144. To the Sheriff or any Constable
of Galveston County. Greeting:
Oath therefor having been made as
required by law, you are hereby com-
manded that, by making publication of
this citation in some newspaper pub-
lished in said county once a week for
four consecutive weeks previous to the
return day hereof, you summon the un-
known heirs and legal representatives
of S. E. Trammell, deceased, defendants,
to be and appear before the district
court, 10th judicial district, to be holden
In and for the aforesaid county of Gal-
veston, at the court house thereof, in
the city of Galveston, at the next regu-
lar term of sard court, to-wit; on the
first Monday in June, 1922, then and
there to answer the petition of Ameri-
can National Insurance Company,
Plaintiff, filed in said court on the 4th
day of April, 1922, and numbered on the
docket of said court 38144 against the
said the unknown heirs and legal repre-
sentatives of S. E. Trammell, deceased,
and R. H. Trammell, and Shearn Moody,
trustee, defendants, and alleging, in
substance, as follows:
That heretofore, to-wit: on the 25th
day of March, 1916, Thomas K. Hall,
otherwise known as T. K. Hall, for a
valuable consideration, made and exe-
cuted his certain promissory note, in
writing, for the principal sum of Four-
teen Thousand, Five Hundred Dollars
($14,5002, payable to his own order five
years after said date, said note provid-
ing for interest thereon, from its said
date, at the rate of eight per cent (8%)
per annum, payable annually on the
25th day of March, principal and inter-
est thereon payable at Galveston, Texas,
and thereafter, and before the maturity
of said note, the said Thomas K. Hall
endorsed his name on the back thereof
and thereby transferred, and, at the
same time, delivered said note to the
Plaintiff herein, American National In-
surance Company, of Galveston, Texas.
That on or about the said 25th day of
March A. D. 1916. the said Thomas K.
Hall, for the purpose of securing the
prompt payment of said note, according
to its terms, tenor and' effect, executed
and delivered to one Frank Webb,
trustee, for the use and .benefit of the
plaintiff herein, his certain deed of
trust and mortgage, in writing, where-
in and whereby the said Thomas K.
Hall conveyed to the said Frank Webb,
for the uses and purposes aforesaid,
about nineteen hundred and twenty
(1,920) acres of land, more or less, sit-
uated in Dimmit county, Texas.
That thereafter, and before the ma-
turity of said note, the said T. K. Hall,
on or about the 25th day of October,
1917, for and based upon the express
assumption and agreement on the part
of the said R. H. Trammell and S. E.
Trammell, by his genera} warranty
deed of that date, made, executed, ac-
knowledged and delivered by the said
T. K. Hall to the said R. H. Trammell
and S. E. Trammell, and then and there
accepted by the said R. H. Trammell
and S. E. Trammell, and, therefore, the
terms, stipulations and provisions
were accepted, ratified and approved by
the said R. H. Trammell and S. E.
Trammell, conveyed to the said R. H.
Trammell and S. E. Trammell all of the
said lands ' hereinbefore described,
whereupon and whereby and under and
in pursuance of the terms and stipula-
tions of said deed the said R. H. Tram-
mell and S. E. Trammell then and there
and thereupon became obligated and
bound and they thereupon, then and
there, promised, agreed and became
liable to pay to this Plaintiff, the then
and now legal owner and holder of said
note, all principal, interest and attorney
fees accruing thereon.
That in recognition, acknowledgment,
ratification and approval of their said
obligation, as aforesaid, the said R. H.
Trammell and S. E. Trammell, or one,
either or both of them, have paid the
annual interest accruing upon said note,
up to the 25th day of March A. D. 1922,
buthave wholly defaulted, and the said
T. K. Hall has wholly defaulted, in the
making of any further payment upon
said note, either principal or interest,
except as hereinbefore stated.

principal and the interest of $1,160.00,
and each interest installment thereafter
(since the 25th day of March, 1921)
have borne interest at the rate of ten
per cent per annum, as by the terms of
said note specifically provided.
That default having been made in the
payment of said note and accrued in-
terest, as hereinbefore set out, the
Plaintiff has declared said note due as
of and from the 25th day of March, 1921,
and has placed the same in the hands of
C. W. Nugent, an attorney, of Galyes-
ton, Texas, for collection, under Con-
tract and agreement to pay to said C.
W. Nugent the ten per cent attormey's
fees on the principal and accrued inter-
est on said note, as provided for there-
in, the same being a reasonable charge
for the collection of said note.
. That there is now due, on the date of
the filing of this suit, and unpaid on
said note, in principal, interest and
attorney’s fees, in the aggregate, the
sum of Seventeen Thousand Two Hun-
dred and Seventy Five and no/100 Dol-
lars ($17,275.00) to pay which, or any
part thereof, though thereunto often
requested, the defendants haje wholly
failed and refused and still fail and
refuse to Plaintiff's damage in the
aforesaid sum of $17,275.00, to recover
which, with further accruimg interest
and attorney fees, and for Costs of suit
and for foreclosure of said deed of
trust and mortgage lien upon all of said
land, this suit is being instituted.
That since the making of said note
and since the conveyance of said land,
as aforesaid, by the said T. K. Hall to
the said R. H. Trammel} and S. E.
Trammell, the said T. K.( Hall has de-
parted this life intestate and, as this
Plaintiff is informed and believes, and
upon such information and belief avers
that the said T. K. Hall left no estate
that could be subjected to the payment
of the note herein sued upon or any
part thereof.
That since the aforesaid conveyance
by the said T. K. Hall of all of said
AUTOMOBILE—Bids in duplicate will
be received by the undersigned until
11 a, m., May 15, 1922 for one new five-
passenger automobile with self-starter
and latest improvements, cost not to
exceed $800.00, and allowance to be
made for one Ford roadster which can
be seen by arranging with county en-
gineer. Usual rights reserved. Address

of Commissioners of the City of Gal-
veston that at a special meeting of said
board held at the City Hall in said city
on Tuesday, May 2, 1922, at 4 o’clock
p. m., it was resolved that the Board
of Commissioners of said city would
meet in special session on the 24th day
of May, 1922, at 5 o'clock p. m., in the
Council Chamber in the City Hall in
said city, for the purpose of presenta-
tion of petitions requesting the submis-'
sion of proposed amendments' to the
Charter of said city, and for such other
business as may come before said meet-
ing in connection with the submission
of proposed amendments to the Char-
ter; now therefore

submission of proposed amendments to
the Charter of the City of Galveston are
notified to appear at said time and place
and they will be heard.

Several million men learned the val-
ue of the sawed off shotgun as a dead-
ly weapon in the course of the war.

S. E. Trammell, the saiql S. E. Trammell
has departed this life intestate, and
as this Plaintiff is informed and be-
lieves, and upon such information and
belief avers and shows unto the court,
leaving no estate whidh could be sub-
jected to the payment of said indebted-
ness or any part thereof, except such
properties as were owned jointly by the .
said R. H. Trammell and S. E. Trammell,
all of such properties being liable in
law for the payment df said debt, after
applying the net proceeds of all of said
lands, when sold.
By reason of the premises, a personal
judgment, exclusive; of. the rights of
foreclosure is sought herein only
against the defendant R. H. Trammell.
- That since the execution of said deed
of trust and mortgage by the said
Thomas K. Hall, hereinbefore recited,
the said Frank Webb,, trustee, therein
has duly resigned of record as such
trustee, and the defendant Shearn
Moody has been duly nominated, con-
stituted and appointed substitute
trustee in his stead, and for that reason
has been made a nominal party defend-
ant in this case.
Premises considered, this Plaintiff
prays that the defendants R. H. Tram-
mell and the unknown heirs and legal
representatives of the defendant S. E.
Trammell, and the defendant Shearn
Moody, trustee, all be duly cited in
terms of the law to answer this petition,
and that upon hearing hereof. Plaintiff
nave personal judgment against only
R. H. Trammell, for the aforesaid sum
of $17,275 and for all further interest
and attorney’s fees accruing thereon,
from and after the date of the filing
of this suit, and for costs, and that as
against the defendant R H. Trammell,
the unknown heirs and legal repre-
sentatives of S. E. Trammell, deceased,
and the defendant Shearn Moody,
trustee, this Plaintiff have judgment
for foreclosure of said deed of trust and
mortgage lien, hereinbefore recited,
against all of said lands, as hereinbe-
fore described; and that Plaintiff have
its order of sale against all of said
defendants, for the sale of all of said
land and that for all or any part, or
such part of said sum that may then
be due, under said judgment, that may
not have been realized net from the sale
of said lands, this Plaintiff have its
execution against the said defendant
R. H. Trammell. And that, meanwhile,
the sale of said land. under said order
of sale, fully and in all things extin-
guish all rights, titles, interests and
equities whatsoever, that either of said
defendants may then have had, may
now have and may ever heretofore have
had in and to all of said lands.
Plaintiff prays for all such other and
further relief, both general and special,
to which, in law and in equity, it may
show itself entitled, etc.. as is more
fully set forth in said petition now on
file in my office.
Herein fail not. but have you then
and there, before said .court, this writ,
with your return thereon, showing how
you have executed the same.
