for acceptable disposal of livestock manure or waste and the proper
cleaning of stock trailers, cars and other pens or enclosurest making it
unlawful to discharge Impure waste and/or fluids onto streets; providing
for a penalty; providing for a cumulative provision; providing for a

TROVILI.F, TEXAS:
HEALTH HAZARD ORDINANCE
Section 1. Definitions, For the purpose of this article, the following
terms, phrases, words and their derivations shall have the meaninggiven
herein. When not Inconsistent with the context, words used in the
present tense shall include the future; words used in the plural number
Include the singular number, and the words used In the singular number
Include the plural number. The word shall Is always mandatory and not
merely directory.

Section 3. PlKharte of Impure Wgur and Huidt into the StrwD; it shall
be unlawful for any person to wash manure or other livestock animal
wastes with water or any fluid from pensand allow such manure or other
livestock animal wastes to run on or into any street or streets (including
U.S. Highway 90) within the city limits of the City of ( ustroville, Texas.
Section 4. Penally. Any person violating any of the provisions of this
Health Hazard Ordinance shall be guilty of a misdemeanor, and upon
conviction shall be subject to a fine of not more than $200.00. Fach day
a violation of any of the provisions hereof occurs may be deemed a
separate offense hereunder.
Section 5. CuotulaUvt Provisions and Savings Clause I hat the provi-
sionsofthis Ordinance shall be deemed cumulative of the provisions and
regulations contained In ail official Ordinances of Castroville, Texas,
save and except that where the provisions of this Ordinance and the
sections thereunder are in conflict with provisions of such prior Ordi-
nances, and In such event the provisions contained herein shall prevail.
It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this Ordinance
are severable, and if any phrase, clause, sentence, paragraph or section
of this Ordinance shall be declared unconstitutional or invalid by any
valid judgment or decree at any court of competent jurisdiction, said
unconstitutionality or invalidity shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this Ordinance,
since the same would have been enacted by the City Council without the
Incorporation in this Ordinance of any unconstitutional or invalid
phrases, clauses, sentences, paragraphs or sections.
The fact that there are presently no adequate provisions regulating
animal waste disposal making the regulation thereof necessary in the
public interest, creates an urgency and an emergency in the immediate
preservation at the public health, safety, comfort and general welfare,
and requires that this Ordinance shall take effect immediately from and
after its passage and publication and it is accordingly so ordained and
shall be effective after publication as required by law.
