that are worthy of support is Abbott's U. S.
Monthly of Chicago. The December num-
ber isu:d about the 15th Inst will contain a
most Interesting article on Texas wlih men-
tion of San Artonlo and view of completed
State Capitol building at Austin written by
S. A. Conant besides a great amount of other
interesting matter.
Tut Houston Post says : "Our exchanges
show a large average of 'stop my pipers'
which is probably the result of the season's
short crop. II an item appears In a piper
not In accord with a subscriber's ideas he at
once endeavors to crush the sheet by a with-
drawal of his patronage. He abuses the paper
roundly with a hope U injure It but he is do-
ing it a beneBt by bringing it before his
acquaintances who will be Induced to take it
Just to see what kind of a critter it is."
An Austin special to the Houston Post
ssys that an organised movement is on foot
among leading Republicans to break up the
so-called ting of Federal office holders In the
Slate and that a bold Hand will be made
against Congressman Ochiltree. There has as
yet been no great evidence that this member
has really got the influence credited to him
but at best it is simply a factional fight of ihe
outs against the Ins and probably will result
It getting rid of a lot of political barnacles
who are no great good to the party or them-
selves. Some of the Pennsylvania oil men have hit
upon a new method of gambling. Last week
40000 barrels of oil were sold In Bradford
Pa. for Immediately delivery and without
any consideration the buyer however to psy
the cellar storsge monthly for 10 yesrs. At
the end of that time h is oil will have cost him
twice as much as it is now worth but what he
saves In compound interest will amount to
more than half the present price of the oil.
Oil mathematicians are at their wit's end try-
ing to solve the problem which will profit by
the transaction the donor or the recipient of
the oil!
The Divorce Question.
One of the evils which is growing and
spreading so rapidly as to fill thoughtful
minds with alarm and apprehension Is the
prodigious Increase In the number of divorces.
This increase In the number of divorces Is not
confined to few Sta'es ol the Union nor is
the increase more notable In Ihe new States
whithef people go to mend their fortunes but
very oflen spend their pittances in going there
and then are left in a position like a ship lhat
Is stranded on the sea shore. The rapid in-
crease In ihe number of divorces in Massa-
chusetts the ancient stronghold of Puritanism
and the present possessor of Plymouth Rock
and Boston the two chief wonders
of modern limes and the germ and fruit of
American progress and civlliistlon his
attracted marked atlenlton and given
rise to much discussion Inside o f
that Slate. In Illinois any Increase in the
number of dlvotces was practically out of the
question since it has long been Ihe resort of
married people from every State In the Union
who had no Just grounds for divorce In the
State of their residence and were content to
put up with a fraudulent and sham divorce.
The facility with which divorces arc obtained
Is a discredit and reproach to any nation; every
possible elTjrt should be made to prevent col-
lusion and fraud between the parlies as well as
to prevent Imposition being practised on the
courts by Ihe party applying for a divorce.
The sscredness and binding obligation of
the marriage vow Is a matter of the utmost
consrquence to the peace virtue morality snd
welfare of nations. Hlitory verifies thisssser-
tlon in Ihe most emphatic manner. Marriage
is in accordance with the law of Nature and
'he law of Nature Is but the will of God
stimped upon.hls works and ihe hearts of his
creatures; and marrlsge Is also shown by the
unanimous testimony of history lo be con-
ducive lo pilvate and public happiness. There
must either be marriage concubinage polyg-
amy or promiscuity of intercourse; ue
must prop and maintain the sacredness and
binding fotce of the marriage vow and
lie or slide into one or the other forms of
sensualism above described. It Is either mar-
rlsge or some form of loose and uncertain
sensualism and we must decide which one of
these shall be the legal institulion. It Is a
mere mockery on Ihe part of the law to sanc-
tion msrriage and prohibit polygamy if no
obstacle be Interposed to ihe procurement ol
divorce and remarriage. The facility wllh
which a divorce can be obtained is merely an
Invitation to men and women to seek divorces
for the most frivolous reasons and grounds
allowed by law. In South Carolina prior to
the war the only ground for divorce was
adultery and the records of her
courts showed very few divorces while
in Slates where half a dortn grounds
existed divorce suits were quite frequent so
that it may be assumed as an indisputable
fact that Ihe very facility wllh which divorces
msy be obtained and the very multiplying of
the grounds of divorce operates as a direct
stimulus to Ihe hankering for a dissolution of
Ihe marriage ties. A French wit who lived
a couple of cenluries ago satirically said that
the married state was ihe only state where all
who were in It desired to get out and all who
were on the outside wished to enter Into it;
but this satire must be taken only at a heavy
discount as the great majority of marriages
are happy connections.
Acccording to Gibbon the Christians of the
two first centuries only tolerated second mar-
riages where the first one had been childless
but they expelled all Christians of either sex
who presumed to marry the third time. The
churches have thrown off these prejudices
against successive marriages and now Inter-
pose no objection to a party's marrying as
oflen as he wishes to do so and can find a
man or woman similarly inclined which is
certainly Ihe wiser and more natural policy.
But I do not mean this to apply to the suc-
cessive marrisges of divorced persons but
only to such as have lost their companions by
death. In a note In his history
of the "Decline and Fall of the Ro-
man Empire" Gibbon mentions a
woman of Constantinople who had bten mar-
ried 21 times and he was so ungallant as to
pronounce her but little better than a prosti-
tute. It is not unlikely lhat some of the per-
sons who are smitten with an itch for being
divorced andwhomsrryonlytogctanexcuse
for prosecuting a suit for divorce may have
emulated the example of this woman of Con-
stantinople who hurried 22 husbauds.
Lord Stowell one of ihe wisest and safest
ol English judges held this language in a
cise before him : "Where (be grounds for
divorce are few in number and parties know
Ihsy must live together they learn to sofien
by mutual accommodation the yoke which
they know they cannot shake off they become
good husbands and wives from the necessity
of remaining husbands and wives for neces-
sity is a powerful master In teaching the duties
it Imposes" and these words embody a great
truth to wit: that multiplying the grounds for
divorce multiplies divorces. In Sheffield vs.
Sheffield 3 Texas 79 Chief Justice Hemphill
thus speaks of Ihe importance of marriage:
"The nature object and important purposes
of the contract should have their just influence
noon the mind. The parties have pledged
themselves not only for their own happiness
but for purposes important to society
to live together during the term of
their natural lives. This engagement is
the most solemn and important of human
transactions. It Is regarded by all Christian
nations as the bssis of civilised society of
sound morals and of the domestic relations
and the relations duties obligations and con-
sequences flowing from the contract are so
important to the peace and welfare of society
as to'have placed it under the control cf
special municipal regulations independent of
the will ol the parties. The parlies cannot
dissolve the contract as they can
others by mutual consent and no light or
trivial causes should be suffered to effect lis
recislon. While lull effect Is to be given to
the statute It should be remembered that
according to the experience of the most
enlightened nations the hsppiness of the
married life creatly depends on lis Indissolu-
bility and that the prospects ol easy separa-
tions foment the most Irivotous qnarrels and
diigusts into deadly animosities. Parties may
not be able to live together very harmoniously
but they cannot be separated except for causes
prescribed by law:" and again " Half the
msrrisges In the country might be dissolved
If occssional freaks of temper were. In legal
contemplation such ill trestment as would
thoroughly embitter the fountains of matrimo-
nial felicity." These views are sound and
weighty and were worthy of the man and the
occasion on which they were uttered.
The laws of Texas have striven to
guard against fraud and collusion by

main sound and just. A jury must find ihe
truth of the material fads allrged before a
divorce can be granted by the District Judge
bnt he Is not bound by the verdict to grant a
divorce as a mailer of course. The defendant
is also required to be represented by an attor-
ney. This is wise and proper. Ilut It strikes
rar that it would be wise in the Legislature
to repeal the statute making abandonment one
of Ihe grounds of divorce Inasmuch as It is
oflen grossly abused. Men and women liv-
ing in other Sta'es move to Texas frequently
for the purpose of obtaining a divorce
on the grounds of abandonment by
the other party. They move Into
other Slates for a like purpose just ts
they flock Into Illinois without becoming
bona fide cillsens. There is no doubt the
alleged abandonment is the result of collu-
sion ts cccssloncd by Ihe very parly who
seeks a divorce or Is the result of a fit ol
sudden passion In a majority of cases. Then
as the witnesses reside In a distant Slate and
are personally unknown to the court there Is
a large margin for the fabrication of testi-
mony favorable to the applicant. The pro-
ceeding Is necessarily exparte notwithstand-
ing Ihe defendant is represented by an attor-
ney appointed for ihe purpose since the at-
torney knows not what witnesses to examine
to disprove the charges alleged in the prtlllon
and has no opportunity of consulting wllh Ihe
defeodant only one side is heard. B.
