ized under the state liquor laws to
transport alcoholic beverages in s

of the State Court of Criminal Ap-
peals.
This opinion was handed down by
the state court after a review of
the case of W. S. Mayes of Abi-
lene, who was arrested and fined
$500 in Callahan County court on
a charge of transporting alcoholic
beverages through dry Callahan
County last December 9.
When Mayes was arrested by
members of the Liquor Control
Board of Abilene, 495 cases of beer
no limit on the quantity of alcoholic
beverages an individual may trans-
port for his own consumption. How-
ever, if he is found with more than
24, 12-ounce bottles or cans of beer
and more than one quart of liquor,

Abbott explained that in Mayes’
caae it was proven that he waa not

self in this matter. Previously the

The beer, according to court re-
cords, had been intended for 495
members of the Abilene post of the
Veterans of Foreign Wars. They
had all chipped in on the cost and
sent Mayes, a fellow member, to
Breckenridge in his truck to get the
beer and bring it back to the Abi-
lene club house of the veterans.
TRANSCRIPT AWAITED
Dan Abbott, an Abilene attorney
for Mayes, appealed the conviction
in Callahan County. He said to-
day that he would have to study
the transcript of the high court’s
opinion before deciding definitely
on the next step, but that he plann-
ed to file a motion with the Court
of Criminal Appeals for a rehear-
ing.
Abbott said the state court’s rul-
ing Wednesday was a new inter-
pretation of an old law applying to
transportation of alcoholic bever-
ages.
The state liquor statutes places
could transport alcoholic beverages
through dry territory if he could
prove he was transporting it for the
individual use of others, and not
for purpose of sale. That was pro-
ven in this case.
"It looks like,” Abbott surmised,”
that the high court is saying that
the only way a private club can le-
gally supply its members with al-
coholic beverages is for each mem-
ber to obtain his own supply.”
Parade Opens
Winters Rodeo
WINTERS, June 24— Winter's se-
cond annual rodeo will be official-
ly opened this afternoon at 5
o’clock with a parade lead by Rep
O. C. Fisher. Performances will
begin at 8 p m.
The featured event of the rodeo
will be a matched roping contest
betwen Rex Beck of Valera and
Dan Taylor of Odessa.
A few visitors have begun ar-
riving in town, but the main
group of contestants is not expect-
ed until almost time for the show.
Entries have been received from
rodeo performers in Talpa, Black-
well, Bronte, Wingate and other
towns throughout the section.
Business houses here will close
at 5 p.m. Thursday and Friday
and at 8 p m. Saturday for rodeo
performances.
The rodeo is being held at the
Blizzard Stadium.

HILLSBORO, June 24. (^ -Sev-
eral thousand dollars in stocks and
other valuable securities were
found among the effects a middle-
aged couple who were killed near
here yesterday in a three-car traf-
fic accident.
The couple were identified as
Mr and Mrs James Watson Scott
of Kansas City, Mo. Funeral home
attendants here said among the
valuables were $23,600 in U. S.
savings bonds.
