Throck Man
Ruled Sane,
Faces Trial
THROCKMORTON - Zach
Turner McWhorter of Throck-
morton now may come to trial
on an indictment accusing him of
receiving and concealing stolen
cattle after a district court jury
ruled him sane Wednesday.
| He is accused of receiving and
concealing the cattle on his Bay-
lor County farm. Three other
men have been charged by indict,
ment with stealing the cattle.
They are Toby Smith Enos (Karo)
Williams, a Negro, and Joe Easley,
all of Throckmorton.
Eight head of cattle are involv-
ed. They were allegedly stolen,
from the Don Buckalou ranch
over a period of six months.
Davis Scarborough and James
Graham of Abilene and Fred
Wright of Throckmorton, attorney
for McWhorter, contended the
man was not legally sane by
virtue of excessive use of alcoholic
- beverages.
McWhorter’s mother, Mrs. Guy
- Huston; his father. Jack McWhor-
ter, and a doctor testified the de-
fendant was insane at the time
of the crime and at present. Mrs.
Huston said her son was an al-
echolic. The doctor said insanity
was due to a swelling of the brain
resulting from excessive use of
