Sentenced For
Tax Evasion
Mrs. Lucille Martinez, 2014 West
Martin, San Antonio, Texas, and
her daughter, Betty Jean Minica
(nee Betty Jean Martinez) were
sentenced Tuesday, Jan. 23 in San
Antonio by Federal District Judge
D. W. Suttle on income tax
violations.
Mrs. Lucille Martinez was
sentenced to serve three years in
prison and fined $7,500 for willfully
attempting to evade and defeat the
income taxes of Max Martinez
Funeral Home for the year of 1965.
The prison sentence was sus-
pended and she was placed on
probation for three years with
supervision. She was also sen-
tenced to a three year suspended
sentence and a $3,500 fine for
making and subscribing a false
joint individual income tax return
which she filed with her husband,
Max Martinez, for the year 1966
Mrs. Martinez was assessed
one-half the cost of prosecution.
Betty Jean Minica (nee Betty
Jean Martinez), 3111 Knight
Robin, was sentenced to three
years imprisonment and a $7,500
fine for attempting to evade the
income taxes of Max Martinez
Funeral Home for the year of 1966
The sentence was suspended and
she was placed on probation for
three years. She was also assessed
one-half the cost of prosecution.
The fines and cost of prosecution
are to be paid within thrity days.
On January 5, 1973, Mrs. Lucille
Martinez and Betty Jean Minica
each pleaded guilty to one count of
an indictment charging them with
attempting to evade the taxes of
Max Martinez Funeral Home for
the years 1965 and 1966 Mrs.
Martinez also pleaded guilty to
Count 4 of the indictment which
charged her with making and
subscribing a false joint individual
income tax return with her
husband, Max Martinez, for the
year 1966. According to the
indictment, Max Martinez Funeral
Home should have paid taxes of
$57,221.34 for 1965 and 1966, but
taxes of only $11,404.54 were
reported on the returns.
A motion was made to dismiss
the remaining counts of the
indictment against Max Martinez
and Patricia Martinez. Judge
Suttle withheld a ruling on this
motion until March 6, 1973.
R. L. Phinney, District Director
of Internal Revenue for southern
Texas, said that in addition to the
sentence, Max and Lucille Marti-
nez and Max Martinez Funeral
Home will still be liable for all
taxes, penalties and interest that
may be due
