AUSTIN — Dreams of Texans
for Nixon and Republicans at get-
ting former Gov. Allan Shivers to
run as a Republican or indepen-
dent candidate for the U.S. Senate
against Sen. Lyndon Johnson just
won't pan out.
Under precedent set in 1956,
Shivers is not eligible to be a
candidate for public office under
another party's banner because he
participated in the Democratic pri-
mary this year.
The precedent was set in 1956
when the Constitution Party
sought to run former Sen. W. Lee
O’Daniel for governor after he
had lost the Democratic primary
to Gov. Price Daniel.
The case went to the Texas Su-
preme Court, which held that
O’Daniel had bound himself to
support the nominees of the Dem-
ocratic primary, and therefore
could not be another party’s can-
didate.
The Constitution Party then
sought to file Mrs. O’Daniel as
a candidate. Secretary of State
Tom Reavley, acting under his
authority as the official maker
of the ballot in Texas, held that
since Mrs. O’Daniel had voted in
the runoff primary that year.
