The State of Texas to the Sheriff or any Con-
stable of Bexar county Greeting:
You are hereby commanded that by making
publication of this citation in some newspa-
per published in the county of Bexar once in
each week for four consecutive weeks previ-
ous to the return day hereof you summon
Adolphus Boehmer and William Boehmer
whose residences are beyond the limits of the
State of Texas to be and appear at the next
regular term of the District Court of the 37th
Judicial District in and for Bexar county to
be holden at the Court House thereof in the
city of San Antonio on the first Monday in
September A. D. 1890 the same being the Ist
day of September 1890 then and there to an-
swer a petition filed in said court on the 15th
day of July. 1890 in a suit numbered on the
docket of said court No. 4032 wherein Martha
M.Tong and H. W. Tong are plaintiffs and
Mary W. Boehmer Mary Jordan >Vm. Jordan
Jay Boehmer Virginia Gildea A. M Gildea
Joseph Boehmer Adolphus Boehmer and
William Boehmer are dqtendants. wherein
plaintiff alleges as follows to wit: That on
March sth 1890 defendant Mary W. Boehmer
by fraudulently representing herseif as the
owner of the entire lot sold and conveyed io
plaintiff Martha W. Took a certain lot or
parcel of land lying and being in the city of
San Antonio county of Bexar and state ot
Texas and described as follows to-wit:
Beginning for the northeast earner at a
stake set on the town tract line on the west
side ot the old Mission road south ol the Sun-
set Railroad company’s track said stake be-
ing 72> s vrasanorth 88‘i west from the remains
of the old stone concrete compuerta or water
gate on east side of the ditch running to-
wards the Mission Concepcion the measure-
ment being taken from the southwest
corner of said compuerta. thence north 88'2
degrees west 105 varas set stake in line at
110'4 varas edge of high bank ot the San Anto
nio river returned to northeast corner thence
along the front ot a fence on west side ot
roads S. 13' 2 west 113 varas to a stake. Thence
south 28 degrees west still following the west
Bide of old r< ad 44'4 varas to a stake tor south-
east corner. Thence north 55'; degrees west
at 16 7 8 varas set stake where the line cuts a
fence running nearly east and west at about
25 varas opposite front line of porch of Boeh-
mer’s house at 86'2 varas graze southwest
corner of said house at 60 varas cut a fence
at 12511 varas set a stake inline at 127 varas
graze along south edge of a much hacked
black walnut 5'2 inches in diameter at 1303 U
varas reach high bank of San Antonio river

one toot in diameter marked X with 3
chops above and below stands 26 1-5
teetdistant to southwest. Below said pecan
about 24 or 25 feet still further stands another
pecan about li lucuus iu diameter marked
similarly. Thence from end of this line up
the river with its meanders to end of first cor-
ner. All of which is shown by the deed »f
said Mary W. Boehmer to petitioner Martha
M. Tong of date March 5. 1890. and of record
in said county of Bexar.
Said Mary W. Boehmer further represented
that she had a good and perfect title there-
to and she desired to sell the same to plaintiff
Martha M Tong. That there had been long
acquaintance between said defendant. Mary
W. Boehmer and Martha M. Tong and they
were connected by affinity. That the said
Martha M. Tong not knowing or believing
that any other person had any right or inter-
est in said land and trusting to the represen-
tations ot said Mary W. Boehmer purchased
said land on the representations of said Mary
W. Boehmer paying therefor 81200 cash and
a note of herself and husband H. W Tong
for $2OO due at six months and took a deed
Irom her with general warranty of title and
was placed in possession thereof but the rep-
resentations of said Mary W. Boehmer were
false and f raudulently made for the purpose
ot deceiving the said plaintiff and did deceive
said plaintiff. '1 hat after plaintiff went into
possession she ascertained that the said
Mary W. Boehmer was not the owner of the
said land but was the owner of only the one-
half thereof and that the defendants Mary
Jordan wife ot William Jordan Virginia Gil-
dea wifeot defendant A. M. Gildea Adolphus
Boehmer William Boehmer. Jay Boehmer
and Joseph Boehmer as children of the said
Mary W. Boehmer and her husband J. Boeh-
mer. were owners of the other half ot said
land. By virtue of a decree of the District
Court of Bexar County rendered on the fifth
day of May 1881 in a suit for divorce between
the said Mary W. Boehmer and her husband
J. Boehmer.vestingthetitleof eaid land inthe
said Mary W. Boehmer and the other defend-
ants as aforesaid as her children and also by
inheritance from the said J. Boehmer. the
husband of said Mary W„ who had died intes-
tate. _
The plaintiffs therefore ask for partition of
the said tract of land between the said Martha
M.Tong and the defendants Mary; Jordan
Virginia Gildea Adolphus William and
Joseph Boehmer as children of said Mary
W. and J. Boehmer. That the collection and
disposition of a note given by said Murtha M.
and H. W. Tong to the defendant Mary W.
Boehmer for part of the purchase money
dated March 51890 for the sum of two hun
dred dollars due at six months after date be
enjoined. And that for the frauds of said
Mary W. iu falsely representing the owner
ship of said land to be in her and deceiving
plaintiffs thereby that the overplus of pur-
chase money paid by her and the amount of
said note if it cannot be reached by inJunc.
