RAILROAD MERGER CASE. The Su-
preme Court of the United .States has
leeeutly decided that its original juris
diction' does not extend over tbe case
presented by the Staile of Minnesota

and'has denied leave to file the proposed
bill. It was sought to have the Supreme
Court take original jurisdiction of this
case on the gfouiiu ilia” it was a suit
la-tween a state and citizens of another
state. The following are extracts frcm
the opinion of Justice Shiras: Briefly
stated the case juesented is that the
State of Minnesota is apprehensive that
a majority of the wtodkholders lespec-
timely of hhe Gnat Northern Rai-way
Company and of the Northern Pacific
Railway Company have combined
through the urgahiration of a corpora-
tion in New-Jersey. whereby such con-
solidation shall he effected a* wilt oper
ate to defeat and cierrule the policy of

tion of parallel and competing lines of

cedid that a majority only of the stock
of the railroad companies is controlled
by the Securities Company and thio
corporation therefore does noty repre-
sent the rights of the minority stock-
holders of the railroad companies. When
it appears to a court of equity that the
cane cannot be dealt with because of
the alisence of essential parties it is
usual for the court to grant leave to
amend by bringing in such parties; but
when it likewise appears that the addi-
tion of dhese parties would defeat the
jurisdiction of the court (the railroads
being domestic corporations} the motion
fur leave to file the proposed bill inimt
be denied.

fact that.the application of tlie law de-
pends upon the size of the estate of the
testator and not the inheritance makes

ges in violation of the constitution of

United States has just handed dowm its
decision in the case of Detroit vs. De-
troit Citizens' St. Ry. Co. 22 Supreme
Court Reporter 411 in which it decides
against tlie right of the city to reduce
from five cents to three cents the fare
to be charged by the atreet car com-
panies of that city. The court hold*
that the oidinances granting the street
railway franchises and the acts which
govern the granting of these franchis-
es do not gtw to the city the right to
reduce the -fare without the consent
of tlie railroad company although! the
law doea say that the fare which any
company may charge shall he establish-
ed l>y agreement between aucii company
and the city and shall not be increased
