That heretofore to wit. on the 30th
day of Octobcr A. D. lft T the defend-
ant R. E. Hinds, of the County of
Tarrant, State of Texas, made cxecu
ted and delivered to VV. R. Hen®ley
also of the County v f Tarrant, State of
TexJ's his two certain promissory notes
each in sum of Three Thousand Seven
Hundred and Fifty Hollars, note No.
one due five years after date and Note
No. two due 10 years after date, each
drawing interest at the rate of 8 per
annum, payable annually as it accrues;
and said notes further providing that a
fuDure to pay either of said notes when
due, or any installment of interest
when due; would at the option of the
owner and holder of said n^ies mature
either or both of said; notes remaining
unpafd at the time of the exercise of
said option, mi id notes also providing
for 10 per cent Attorney's fees if placed
In the hands of an Attorney for collec-
tion or if collected through legal pro-
ceedings; said note* due and payable
to the order of W. R. Hensley at Ft.
Worth, Texas; and were given for part
of the purchase money of and for the
following described real estate, situated
and lying in Burleson County, Texas
and more particularly described as
follows, towit:-
AH that certain tract or parcel of
land, being a part of that certain
league of land known as the 8. C.
Robertson League No. 8 of date 18th,
day of March, A. D. 1835, and being a
part of that certain tract of 1062 1-2
acres set apart to Lela Robertson by
commissioners of partition of the estate
of S. C. Robertson, deceased; and
known and described as the North
part of said 1062 1-2 acres and described
by metes and bounds as follows, towit:
Beginning at the original North
West corner of said league No. 8:-
Thence S. 30 E. with the west bound
ary line of said league at 1695 vrs. a
stake In W. boundary line for S. W.
corner of this tract, 706 vrs. N.30 W.
of S. \V. corner of said Lela Robertson
1062 1-2 acre tract:
Thence N. 60 E. parallel with said
boundary line of Mid Lela Robertson
1062 1-2 acre tract 2500 vrs. to a stake
in the East line of said Lela Robertson
1062 1-2 acre tract, 705 vrs. N. 80 W. of
it's S. E. corner, said stake being the
S. E. corner of this tract:
Thence N. 30 W, with East bound
iiry line of said Lela Robertson tract
at 1605 vrs. to the original North
boundary line of said Robertson league;
No. 8 a stake for the N. E. corner of
this tract and N. W. corner Jof a J1062
1-2 acre tract set apart to Walter Rob-
ertson out of said Robertson League
No. 8:
Thence S. 60 W. with the original
North boundary line ot said league No.
8 at '¿idO vrs. to the place of beginning;
containing 750 acres of land.
That said property was heretofore
towit, on the 30th day of October, A.
D. 1907, conveyed to said R. E. Hinds
by W. R. Hensley by his deed of writ-
ing of that date, in consideration among
other things of the two notes above
set out and described, and that in said
conveyance a lien was reserved thereon
to secure the payment of said notes in
favor erf W. R. Hensley.
That said notes were before maturity
and for a valuable consideration with-
out recourse on him, sold and trans-
ferred by written transfer of record in
deed reoords of Burleson County, Tex-
as, and by indorsement on the back
thereof by said W, R. Hensley to C. O.
Wyattand wife W. A. Wyatt; and by
said C. C. Wyatt and wife W. A. Wyatt
to W. W. Watts and by said W. W.
Watts to the plaintiff Prank B. Clare
and that said Prank B. Clare to now
in said notes; « d that the defendant
is justly imlebt: 1 :o the plaintiff in the
principal sum of $7500.06 with interest
thereon from Oct. 80th. 1M07, until this
date at the rate of 8 per cent per annum
payable annually, as well as for 10
per cent Attorneys fees on the whole
amount e s well as all costs in tills be
half expended.
Wherefore plaintiff prays for citation
to thte defendant R. E. Hinds by pub-
lication, and that on final hearing he
have judgement for his debt, interest
and Attorneys fees, and for a foreclos-
ure of the Vendor's lien on said lands
above described as the same existe ! on
the 30th. day of October, A. D. 1007;
and that order of sale issue and that the
officer executiug the same place the
purchaser at said sale in possession
there of within 30 days after date of
sale; and for such other and further
relief in law and in equity as he may
show himself justly entitled for all of
which he will ever pray.
Herein fail not, but have you
then and there befo re said court,
this writ, with your return
thereon, showing how you liave
executed the same.

The Port Bolivar Iron Ore
