Judicial District Court of Nueces
County, Texas, on a judgment
rendered in said court on the 26th
day of July, 1995, against John W.
McKellip, Donna McKellip,
Texergy Corporation and KTX
Management, Inc., jointly and
severally, and being No. 95-4235-
E, on the docket of said Court , I
did: (i) at 11:10 o'clock a.m., on
the 13th day of November, 1995,
levy upon the following described
real property; and (ii) at 12:30
o'clock p.m., on the 13ih day of
November, 1995, levy upon the
following described personal
property, belonging to the said
Texergy Corporation, to-wit:
All of the right, title and interest
of Texergy Corpoiation in and to
those certain leasehold estates as
described in Exhibit A attached
hereto and incorporated herein by
reference together with all the
Texergy Corporation's right, title
and interest in all pipeline
easements and rights-of-way
situated thereon or used in
connection with production
therefrom and together with all of
Texergy Corporation's interest in

Texas Natural Resource
Conservation Commission
(TNRCC) for the construction of a
paper processing facility. The
facility will require the purchase of
a baler that will enable paper
processing at minimum/maximum
ranges of 5-7/8 tons daily.
