of execution issued out of the 148th
Judicial District Court of Nueces
County, Texas, on a judgment
rendered in said court on the 26th
day of July, 1995, against John W.
McKellip, Donna McKellip,
Texergy Corporation and KTX
Management, Inc., jointly and
severally, and being No. 95-4235-
E, on the docket of uaid Courtl, I
did: (i) at 11:00 o'clock a.m.. on
the 1st day of March. 1996, levy
upon the following described real
property; and (ii) at 11:00 o'clock
a.m.. on the lsl_day of March.
1996, levy upon the following
described personal property,
belonging to the said Texergy
Corporation, to-wit:
All of the right, title and interest
of Texergy Corporation in and to
those certain leasehold estates as
described in Exhibit A reference
together with all of Texergy
Corporation's right, title and
interest in all pipeline easements
and rights-of-way situated thereon
or used in connection with
production therefrom and together
with all of Texergy Corporation's
interest in and to all personal
property, lease and well
equipment and machinery situated
thereon and used or obtained in
connection therewith.
