49.2104. Minimum Required Services.
(a) At a minimum, each contractor
must arrange for, or provide, the following
three services to eligible children and
families:
(1) family crisis intervention
counseling. The contractor must give priority
to attempting to divert the child from emer-
gency residential care. Family crisis interven-
tion services are defined in 49.2101 of this
title (relating to Definitions);
(2) emergency residential care.
These services are defined in 49.2101 of this
title (relating to Definitions);(3) after-care services for the child
and family. These services are defined in
49.2101 of this title (relating to Definitions).
(b) Contractors may provide the min-
imum required services directly, or they may
use other providers for one or more. Existing
services should be used if available.
(c) In certain circumstances, rural
contractors may begin providing some ser-
vices before emergency residential care
within the catchment area has been devel-
oped. Residential care services must be in
operation as soon as possible, but no later
than one year after the contract's effective
date.This agency hereby certifies that the rule
as adopted has been reviewed by legal
counsel and found to be a valid exercise
of the agency's legal authority.

Insurance Code, Chapter
5, Subchapter L

Register publishes notices of actions taken
by the State Board of Insurance pursuant to
Chapter 5, Subchapter L, of the Code.
Board action taken under these articles is not
subject to the Administrative Procedure and
Texas Register Act, and the final actions
printed in this section have not been pre-
viously published as proposals.
These actions become effective 15 days after
the date of publication or on a later specified
date.

not be published, but may be examined in
the offices of the State Board of Insurance,

The State Board of Insurance has ap-
proved, as part of The Texas General BasisSchedules, the 1987 Edition of the Na-
tional Fire Protection Association's Stan-
dards for the Installation of Sprinkler
Systems, the 1987 Edition of the National
Fire Protection Association's Standards
for General Storage, the 1986 Edition of
the National Fire Protection Association's
Standards for Rack Storage of Materials
(as amended), the 1986 Edition of the Na-
tional Fire Protection Association's Stan-
dards for Storage of Rubber Tires (as
amended), and the 1984 Edition of the Na-
tional Fire Protection Association's Stan-
dards for the Storage of Roll Paper (as
amended), each of which sets forth ac-
ceptable installations of automatic
sprinkler systems for the purposes of
allowing credit in the published fire rates
of individual buildings utilized for various
types of occupancy. In addition, the State
Board of Insurance has approved a revi-
sion to the State Board of Insurance's sup-
plemental sprinkler rules which set forth
specific exceptions to the National Fire
Protection Association guidelines for the
installation of automatic sprinkler
systems. The exceptions produce minorchanges to the standards set out by the
National Fire Protection Association and
are used in instances where NFPA stan-
dards do not follow a particular engineer-
ing criteria that is acceptable for the
installation of automatic sprinkler
systems in Texas.
These changes are to be effective 15 days
after publication in the Texas Register.
This notification is made pursuant to the
Insurance Code, Article 5.96, which ex-
empts it from the requirements of the Ad-
ministrative Procedure and Texas Register
Act.
