V. JUSTICES OF THE PEACE
Since the organization of Caldwell County in August 1848, provision
has always been made for the establishment of justice precincts as subdivisions
of the county and for the election of justices in the precincts.1
Justices of the peace were among the first officers to qualify in Caldwell
County.2 At present it is required that each county be divided into at
least four precincts and that a justice be elected in each; the maximum
number of precincts and justices permitted is eight. The justices are
elected by the voters of their respective precincts at each biennial general
election.3
The justice courts are the tribunals for the trial of minor civil
cases and petty misdemeanors.4 As committing magistrates, the justices
hold examining trials .Cor the purpose of making inquiry into criminal accusations
to determine whether persons charged with crime should be discharged
or bailed.5 They are also ex-officio coroners,0 and registrars
of births and deaths in their precincts.7
