The Texas Department of Mental Health and Mental
Retardation has adopted the amendments to Rule
302.04.06.007 under the authority of Section 2.11(b),
Article 5547-202, Texas Civil Statutes, to read as
follows:.007. Care of Patient or Resident while in Restraint
or Seclusion.
(d) Immediately after placing a patient or resi-
dent in seclusion or restraint or at the earliest time
feasible. the patient or resident will be explicitly told
what behaviors are expected of him while in restraint
or seclusion and that release will be contingent upon
the patient or resident behaving in the indicated man-
ner (see the seclusion checklist which is attached to
this rule as Exhibit A for a period of one hour and 15
minutes Ifive consecutive observation periods).
Ig) Bathroom privileges shall be offered at least
every two hours and recorded in the seclusion checklist.
