parts? Where is its candor on tho subjoct
of common or free schools? On this sub-

ccodidly set themselves to work. They be-

thai ihe Stato should educate those only un-
able to obtain an education othorwise but

now and ever will exist in our Stale to'tbe

T.rcsoal Constitution were in favor of it.
Its very language nnd liberal provisions
on the subject demonstntcB its candor. It
t.-U'Js like a system of free schools was to
!io ev.abliehed and that thero was certainly
to be a very considerable amount of funds
provided and set apart exclusively for that
object. The now Constitution also seems
m'rciid liko an exceedingly groat system of
lYee 'ichools is to bo established. Immense
riur.utities of lands nnd money &e. aro by
ji.j means omitted or deemed unworthy of
beiMtf set apart nnd styled "perpetual."

vhu a small amount of scrutiny will re-
veal. Section 2. Art. 10. of the new ConJ
Mit'ilion makes it obligatory on the Legis-
Lit ure at an early day to put Into bpera-
i i"n throughout the State free schools.

or wye it makes "perpetual" all the funds
lutids and other property heretofore "set
np irt" or that may bo set opart and appro-

positively asserts that "no law shall ever
be n ado appropriating said fund to any
oihcr use or purpose whatever." The 8d

nate sections of land of nil grants horeto-
for nnd hereafter to be made to all Rail-
Bo'uls &c. And further provides that if
Hie State ever sells to the U. S. any lands

henceforth appropriate one-half of all Bales
of the publio lands to the school fund. The
4th seolion makes it obligatory on the Leg-
islature from lime to time to sell lands be-
longing to the school fund to purchasers
on time and terms but most positively in-
hibits mercy. - No relief or extension of
time Is to be given to the poor devils who
mny be the purchasers. Payments to be
forfeited to tht fund if punctuality ii not
ir.ctly observed.

evade thia dilema by trying to draw a die-
tioction between contracting debts and
pledging the faith of Ihe Slate for Ihe pay-
ment of money to third pnrtioa by "guar-
antees' for the benefit of gentlemen en-
gaged In tho coinmoudable avocation of
building Kail roads. The subtorfiige if
attempted will deceive nobody. Tho two
sections are antagonistic and can not bo
reconciled.
Scotion 7 Art. 10 le rnlhor a curiously
worded thing. It mny be all right but il
eandor might have bcon Improved. It pro-
vides for the levying of taxes fori ducullon-
nl purposes on tho nogro as woll as the
white race. It expressly says that tho
taxes paid by the negro shall be "exclusive-
ly appropriated for tho uiaiutrnanoo of a
system of publio schools for African and
their children. It nowhere says that the
white man's money shall not bo appropri-
ated for the benefit of Ihe negro. Hut on
the contrary It docs say that it shall bo
the duty of the Legislature to encourage
schools among these people Encourage
how? By appropriating the white man'
money for that object I Is this tho mean-
ing? If it is it seems that negro children
are by this section placed atleast "one dot"
over the white. It is bolicvcd nothing of
this kind was intended. Hut if not why
was not tho Intention candidly and clearly
expressed. But if tho new Constitution is
objectionable as it is believed to bo in
point of candor in the above nnd other pro-
visions that might bo enumerated should it
ever- by a vote of tho pcoplo become opera-
tive thcu ourorgaiiic law will at least
posscsB one exceedingly important feattiro
in which neither nerve nor candor is want-
tng. Tho ordinance entitled "An ovdinanco
to provide for a division of tho State of
Texas" confers on the first Legislature that
may see fit the power to go about dividing
the State iulo any number of petty States
with as little ceremony as a thoughtless
boy would exercise in drawing a dead line
in a game of marbles.
No preliminary test or subsequent sub-
mission of the matter to the peoplo is con-
templated. Tho boldness and decision of
this ordinance are commendable but its
consummate nnd lamentable folly and its
total want of Statesmanship are clear and
unquestionable. Texas os n unit is des-
tined at no distant day to wield a mighty
a controlling political influence. Let tho
new Constitution be ratified by the peoplo
at the ensuing eloction nnd for ought we
know the very next set of LcgislatiW so-
lons will in a day slice the Stato into half
doscn weak potty poverty-stricken con-
temptible parcels called States.
Whq desires this? If any let him voto
"for the Amendments." Thero aro many
very many other objoctionnblo features in
the new Constitution. But this communi-
cation is already too extended.
A few words more. It is by some being
urged in favor of tlio new constitution
that the opponents of itadicalism should
vote for it for fear that jf it is rejected
another Convention will be called and bo
composed of men less sound politically
than the one just adjourned. In answer
lo this it may be said in the first place
why not still live undorouv present Con-
stitution and in the second place if anoth-
er convention is called there is scarcely a
county in the State but what can elect men
untainted in principle. This representa-
tive district elected men of undoubted
soundness and it is known that many of
the oountios that elected gentlemen of the
"ah initio" school of politics to the late
Convention could easily have done better;
but under the apathy and depression thnt
followed our sad defeat tlioy selected and
sent unsound men; under the false ides
that tbey had to do something of the kind
to obtain a speedy relcnBe from military
rule. This will hardly ever ocour again.
It is always safer for voters to confer trust
on and repose confidence in men enter-
taining principles identical with them-
selves. We up here will on the fourth Monday
in Juno give Hon. J. W. Throckmorton
and a 1 those on the ticket with him an
overwhelming majority.

that order have been received from Wash-
ington directing the commander of this
District to muster out of service all the
volunteer troops except a very small num-
ber of negroes to be kept atationcd proba-
bly on the Rio Grand. The places of the
troops mustered out will be suplicd by reg-
ulars. Jloutton Telegraph.
They are manufacturing their own Ice In
San Antonio at Ihe rate of 1200 pounds
per day. This must be a great luxury to
the large and flourishing inland city of our
State.
