that he had under consideration
two opinions from tho Attornoy
Genural as to legal questions aris-
ing from cases commonly known as
reconstruction acts and that in

subject and various interests invol-
ved ho doomed it propor to havo it
considered fully by tho Cabinet
and avail himself of all tho light ho

they participated in the rebellion. Two
things must exist in the opinion of the
Cabinet to disqualify any porson from vot-
ing first those who held ollice prior to the
rebellion and afterwards participated in
the rebellion.
14th. An act to fix upon a person the of-
feuoe of engaging in rebellion under this
law must be overt and voluntary and done
with intent aiding common purpose. A
person forced into rebellion cannot be dis-
qualified. All vote aye exaeyt Secretary
of War.
15th. Mere acta of charity when intend-
ed to relieve wants and object of such char-
ity not done in aid of such oause does not
disqalify but voluntary contributions to
rebel cause even such indirect contribu-
tions as arise from voluntrry loan of money
to rebel authorities or purchasing of bonds
work disqualification. All voted aye.
10th. All thoso who in legislative or
other official capacity engaged in rebellion
are disqualified but officers during rebel-
lion who discharged official duties not in-
cident to war such as governor of State
are not disqualified. Disloyal sentiments
or sympathy would not disqualify but
where a person by speech or writing incited
others to engage in rebellion be must be
disqualified. All voted aye except the Sec-
rotary of War who dissents to second par-
agraph witii exception of words "where a
person shall by speech or by writing inoite
others to engage in rebellion ho tuust be
disqualified.' .
17th. The ditties of the board rppointed
to. superintend elections. This board hav-
ing the custody of the list of voters for
mliich it is constituted must see that the
names of persons offering are found on reg-
istration list and if such proves te be the
fact it is the duty of tho board to recoive
the voto of those qualified by residence.
They cannot receive voto of any one whose
nume is not upon the list. Hoard cannot
entertain any inquirfes as to qualifications
of any persons not offered to voto. All vote
aye.
18th. Themodo of voting provided in not
to be by the ballot. Board to keep a record
and poll book of tho elcotion showing votes
list of voters and persons elected and to
make returns to the Commanding General
of the District. All vote aye.
lUth. Board appointed for registration
and superintending oleotions must take
oath prescribed by act July 2d 1862. All
voted aye.
In Cabinot June 20th 1867. rresout
same Cabinet officers as on 18th except
only Secy of Interior. President said that
nfti-r full deliberation be concurred with
the majority on three sections of summary
upon which the Secy of War expressed dis-
sent and that he concurred with Cabinet
on thoso sections approved by unanimous
vote that as it opposed military comman-
ders intentional doubts on points covered
by summary and as their action hitherto
has not been uniform be deemed it proper
without further d lay to communicate in a
general order to respective eommandors
points sot forth in said summary.
