from Ban Saba. Suit to enforce mechanic's
lien under P. I. Art. 7112. Jury having
been waived personal Judgment against Lo-
sing was rendered for $410 and tho mechan-
ics lien ou building and lot enforced and sale
ordored. The judgment recited that "es ecu-
tiou may issuo according to law on or after
the expiration of a hundred days from the
adjournment of the present term of this
court and not bofore. The above decree is
rendered by agreement of parties." The legal
effect of this recital was to mako tho judg-
ment one by consent. 22 Tex. 276. This
was a waiver of all' errors except a funda-
mental error which would go to the jurisdic-
tion of the court tho latter being Buch a
error as could not be waived even by consent

diction over a case involving the question of
a mechanic's .lien : the petition sought the
enforcement of such lien; the judgment
rocites that evidence of such lien was shown
upon the trial ; the judgment was entered by
consent and thereby Les&ing bad tbe benefit

presented it docs not appear but that the
court had jurisdiction and the 'judgment

pellant was charged in the lower court by
indictment with theft. It is recited iu the
judgment thabthe defendant pleaded guilty.
Ia his instructions to tbe jury the judge tells
thorn that thodofenlant "huving entered tbe
plea of guilty you will by your verdict find
him guilty and assess bis punishment at con-
finement in 'the penitentiary not less than
two nor more than ten years." Defendant
was found guilty and his punishment assessed
at two v rus. In his motion for new trial
oiiuu'ni9 grounds relied on was that the
judge failed to udmonish him of tbe conse-
quences of pleading guilty etc. If - tho
defendant plead guilty heshail be admonished
by the court of the consequences; and no
such plea Bhall be received unless it plainly
appears that he is sane etc. Art. 118 0 C.
e. Tno record fails to show that the plea
of guilty was pleaded in conformity with the
requirements of tbe statute and thejudg-
ment is therefore reversed and remanded.

lupe. 'The recital in tne judgment is that

guilty "whereupon came a 1ury of good and
lawful men to-wit: P. H. Ebaer who were

appears to have been tried by a jury com-
posed of one juror. We might naturally
indulge the presumption that five other
jurors were impannelled etc. but we are not
authorized to presume anyining wnicn tne

J. B. Lygo who was arrested on charge of
violating tho U. S. postal luw was arraigned
before U. S. Commissioner Burford yesterday.
Two witnesses were extminedwhen the case
was postponed until the 9th of June and in
default of $600 bond tho prisoner was
committed to ail. Tbe complaint was
brought about by Mies Lizze
Sloon a young lady who was koeping house
for Lygo who charges tbat he intercepted
and 6 pe"ned letters of hers without hor con-
sent or knowledge. She came here from
Qrant county Minnesota and the letiors she
wrote home to her parents never oliciiod any
answerand she thought very straugo of it as
she wrote repeatidly. All this time her
parents were writing lotterB
to ber and they wero on tho
other hand at a loss to account for the seem-
ine reticence of their daughter. This was a
good while ago and at last her father wrote
to a prominent oiuciai or mis city to go ana
see his daughter and informing him tnat he
had written her but had never rtceived any
reply. Her father sent ber money at the
same time to come coins iu? oi-
cer aeauaiulod her with the contents
of the loiter ho had received and finding that
her parents did still care for her she lott lor
her home. An investigation followed which
resulted in tho arrest of Lygo. Thj father
stated in bis letter to tbe officer tout he
understood that his daughter was a
material witness in u suit ot Lygo s
ncainst soma insurance company
and tbat he wan dotaming her and intercept-
ing her letters in order to retain her as a
witness iu bis Denau in tno case.
