On what principle of justice or equity

law is nmt practicable In Texas at this time
and sbouid not be enacted until les radi-

we do bavo a herd law let it be one that
will relieve our farming classes ot their

This seotion has another oerlous defect in
that it permits an ownpr of stook In sxafB

of monopolies. It will have a tendency
and very rapidly too to force men with
over 25 and less than 5000 head to sell out
their stock to tbe large syndicates. It will
sacrifice tbe hard-worxing comparatively
mall stockman to the rich one who con-

this as the battle cry turn a large part of
our citizens over to the tender mercies of

IN OKK DILL.
But Mr. President admit that the blil is
as perfect ti solution of tbe question as
some of the press and the senators contend
that it ia what are wfttosuy 01 the means
prepared to euforoe it?
I am not much surprised that so many
editors have lavored it for it creates au of-
fice for nearly every friend of the hill.
I nave no doubt but wha; this feature
of tbe bill would commend it to those mem-
bers of the senate win se teruia soon expire
but for tha f tot his Excellency so fur bus
not discovered as much ollic:ul talent iu
this body as iu the other hoie.
The bill prOTiJes for an unlimited con-
etahulary forco and the necessary 'Z- of
this lorce was so lurge even in the entma-
lion of the senator Iroui Travi-i ihathelelt
the number Dlunk lor tear there wouldn't
be democrats enough to fill tbo places rank
and tile.
He left tbo amount of tbo approprialion
blank because lie evidently thought it
would take all tin- profits out ol the million-dollar
preamble to the bill. Whenev-
er tbe senator fills up these blanks he will
find that it ia a mero ma ter of choice who
enta up the children's grass" tbe office-
holder or the stockman.
Tbis bill has more military and money in
It than there is grasB on the school laud
and an amendment may be ueces.iury to
eave the money already received from the
tale of the school lauds.

1 am atraid that so many troops and so
much constabulary is provided tor that it
will require I he manufacture of more colo-

limit placed iu this bill on cattle. But the
constabulary and tbe military force to sup-
press these treasonable practices don't wor-
ry me half as muc'i as tbe next section of
the bill providing tor ten grass corumitsion-
ers with the salaries ol district judges and
expenses paid. These ten grass commis-
sioners may go to seed early and produce
twenty more grass commissioners and
their salaries and expense accounts might
choke the life out ot the scaool fund.
It is provided that each one of this "New
Issue" shall have jurisdiction co exieneive
witn the state and shall be entitled to a
military escort. Each one shall be a rov-
ing satrap. Right here I have a vision and
I see these learned grass commissioners
traveling around promiscuously. In one
side ot their Baddle-baga tbey have the re-
vised statutes together with 8enator Ter-

they have a chunk of dried beef which

extraordinary and extravagant bill. Those

evideutly popular as there are forty bills

TlIEIIl INTERESTS.
No man has less sympathy with com-
munism than mysell but when there am
grievances complained 01 they should tie
diligently inquired into und llie evil cor-
rected. While nine-tenths of thu fence-
cutting has been done without excuse
there were complaints that should buve
bad a patient hearing long since.
The law sbouid check ail monopolistic as
well as commun stic tendencies lor botu
result in tbe impoverishment of the people
and will prove destructive of our institu-
tions. One produces tyranny the other
anarchy.
I deny most emphatically the charge of
tbe senator that the slate encourages com-
munism by not forcing its citizens to pay
tor tbe grass ou the public domain. Tbe
law of supply and dctnaud will prove suffi-
cient in this case to give value as il has
always done so the lands will be leased
speedily enough wbeu you give assurance
of full protection for tbe t rowdiug of the
range will force such a re-
sult. We have never given
an opportunity to those people to leasa the
school lands. . As population increases tbe
agricultural interests will absorb the agri-
cultural land and tha stuck interests will
settle dewn on the grazin r lands. By Im-
mense donations of land we forced railroad
building ahead ot tbe demands of the coun-
try. We forced our lauds on the market at
low prices. By large expenditures of money
you might Bay we bave forced immigra
tion into the state and now prop se to
fores the people to leave the lund. These
forced measures are bearing their fruits
for our social conditions and ihe character
of our population have been changed bo
rapidly that the diil'treur. elements have
Lad no time to ssiimilate or blend. Tbe
senator has an areravated case ot Ameri-
can fever and rnted to do everytutng at
once. He cu't wait for tbe seasous but
must resort to Ibe hot house growth.
You can't expect the Scottish lord or
cattle corporation president and the born
and bred cow-boy to fill in love with each
other at first sight but make them observe
each other's rights for t. while eud they will
soon become good neig'ioors.
Don't lyginlate as the bill proposes to do
so as to bave the greater swallow tha less
for tbe quiet resulting taeretrom will be as
transitory as Jonah's residence in tbe
whale's belly..
Wby should we legislate so strsnuonsfy

ami the opposition of come ot ine
ablest senators because they claimed
that it inude no difference where the

No man fears more than myse.f too results
ol allowing corporations to own or control
the land of tbe country especially those
jorpt.rat ons who desire to retain the
ownership of t:ie vast tracis to be used In u
busmejs that neither enriches or improves
tbe laud nr settles th country. Tnia and
every other stale should guard against this
growing evil. Thus lur the senators and
myself are agreed and i! this lit-tit. bad

He ia now theoretically as rabid its I
would have him against me encroachment
ot corporations but bis bill has no nitum
tion against them and practically ia in
their interest.
Tdh senator meets u again with the old
cry "pui money t-to the school fund" und
save tne p-ni'le from taxation. This samo
cry beguiled the people in sustaining you
m this sulc of lands at 53 ceniB and $1 that

is the only consideration why not do with a
lets pretentious cuflitol ouilding inito td ot
granting to a corporation over three million
acres of land in one body upon which the
sons of men will Bigh iu yam for a home
and a chance to work if that corporation
caooses to stock it. In our greed to hasten

Two years ago only in a spirit of

escaped the grasp of corpor tie wealth limy

I am nocoiumuuiHt. and have no patience
with communism and waut to sea every
man eujoy the fruits of his labor; but
feudalism with its flesh and blood leaiures
has more to commend it than corporate
power without such features.
In our anxiety to realize a few dollars for
years we should not lose sight of tbe tact
that the happinesB ot a people depend upon
their ability to earn in contentment a liv-
ing and that the government which ruth-
lessly deprives them of that right can ex-
pect OBly by fotca to j-icure actjuisoeuce iu
such a policr. To say nothing Of
tbe stranger without our gates we have
but little left as homes tor those to tbe

but we don't want to make the same kind

nor are we willing to tuke grass commis-

We want tht country to prosper and pro-

haste tn maturity means hasie to decay.
Mr. President I must suy that while I
have always advocated a good school sys-
tem nod want it us cheap as possible; thai
while like ihe senutor from Travis I love
the farmer on principle there beii.p; a largo
majority in ray d'E.nct I can't see how it
would help him and do sea where it might
injure him and bis children and that while
I desire to see quiet restored I don't sec
how Ibis bill would do it as men would
quarrel more tba a ever about each other's
stock running on grass they hud paid tor.
so FAB
as the constitutionality of the bill is con-
cerned I don't esre to discuss it alter the
argument tf the senator from Briar out if
not unconstitutional it ought to be; he
had just as well try to cram all the Old
Testament into tba book of Genesis as all
thii legislation into one bill. Our policy
should bs to get all the taxes and rent out
of tbe stock man that we can see that he
observes tbe rights of others and then pro-
tect bim lu his own rights.
Dou't bind him band and foot or banish
him nr make him au outlaw because he
has made inonev out of grass that he has
driven tbe bultalo and tun Indian from.
Bring bim under tbe control ol the law. let
