WASHINGTON Fob 10. A question
of constitutionality lias arisen In the
nation's official circles which may
lead to a puzzlesomo domestic tangle.
The Issue as it now stands is as to
whether or not Senator Philander C.
Knox of Pennsylvania is eliglblo to a.
portfolio in Presidentelect Taft's cab-
inet. Taft line announced his inten-
tion of having Knox as secretary of
state Insomuch as that gentleman is
said to possess diplomatic qualifica-
tions second to none.
There is a certain provision of the
federal constitution which prohibits
the appointment of a senator to an of-
fice created or a salary which has
been increased during the term for
which he has "been elected. Specifically
the constitution says:
"No senator or representative shall
during the time for which he was
elected be appointed to any civil ofllco
under the authority of the. United
Satcso which shall hava been created
or the emoluments whereof shall have
ben increnscd.durliig such t'.tuc;nnd
no person holding any ofllco under
thet United States shall bo a member
of clthor houso during his continu-
ance In offlco."
It Is reported thnt even Senator
Knox himself is disturbed from his
usual imperturbatiou arid is seeking
legal advico on thb subject.
