All of the aulta grow out of a tran-
saction relative to certain promiula-
aory uotea given by Winnie ft Feath-
erstona to Weekes McCarthy ft Co.
Winnie brought suit against
Weekea McCarthy ft Co. alleging
that on the lith day of October 1898
be waa tba owner of nlnety-flve of
the first mortgage bonds Issued by
the Qulf and Interstate railway or
Texas of the par value of $1000 each;
that on or about the 13th day of No-
vember 1897 flalntlff liad pledged
aald nlnety-flve bonds of the compa-
ny with the defendanta In order to
secure payment of a certain prom-
issory note for the sum' of $28000
made and executed by the firm of
Winnie ft Featheratone of which
plaintiff was a member;' that later
the not was paid but that notwith-
standing this defendants failed and
refused to deliver to plaintiff the
nlnety-flve bonds although plaintiff
made proper demand therefor; that
defendants fraudulently converted
and appropriated the bonds of plain-
tiff to their own use for which he
asks damages to the ' amount of
$125000.
Winnie & Featherstone's petition
to cancel notes recites that on or
about the 13th day of November 1897
plaintiffs delivered a prommlssory
note for $28000 payable on or before
six months with Interest at 10 per
cent and did thereupon execute and
deliver to H. Ridel as trustee a deed
of trust whereby they (did transfer
in trust to Ridel to secure the note
among other property j all of the
bonds and stock owned by them In
the Gulf and Interstate railway; that
oi May 28 1898 a certain prommis-
sory note for the sum of $6440 bear
ing interest at the rate of 10 per cent
a year from August 29 1898 secured
under and by virtue of the deed of
trust referred to was Issued by plain
tiflu.
Plaintiffs also state that after the
notes and Interest were ipaid in pur
suance and by virtue of a certain con-
tract entered into between plaintiffs
and defendants whereby defendants
were to accept in settlement of notes
certain claims demands ' and vouch-
ers owing by the Gulf and Interstate
to plaintiffs that notwithstanding
the notes were paid defendants re-
fused to surrender or transfer to
plaintiffs the notes and still hold
and claim them. Plaintiffs ask for
cancellation of notes and surrender
of them to plaintiffs and that pending
the suit defendants be enjoined from
selling transferring assigning or
conveying to any one any of the se-
curities claims vouchers accounts
stock or bonds so named.
Featherstone's suit is for $100000.
He alleges as detailed in the petition
of Fox Winnie in his suit for dam-
ages except that Featherstone alleges
he pledged with Weekes McCarthy
& Co. certain first mortgage bonds
of the Gulf and Interstate to the val-
ue of $74000.
GONE TO SAN FRANCISCO.
Mr. A. F. Hlnx yesterday completed
all details relative . to transferring
the site letting contracts etc. and
left last night for San Francisco. Mr.
Hlnx stated to an Enterprise reporter
that he would return about Septem-
ber 1. x
E. Goldsmith who has been Mr.
Hinx's right hand man through all
the transactions will remain In
Beaumont In full charge of the mill.
J. A. Petty architect will probably
begin breaking ground tomorrow and
just aa soon as Mr. Carrolls residence
can b moved construction will begin
on a large scale and be rapidly push-
ed to completion. All of the contracts
have been let for building material.

except to get the ground cleared of
buildings etc.

ness. The Pee Gee depot proposition Is

er officials are to visit Beaumont at
an early date and take active steps
In the matter. Beaumont's difficulty
in securing suitable sites for factor-
ies etc. of late has evidently con-
vinced the railroads that if they want
desirable locations there Is no time
to he lost.
