Taxation' of Intangible Assets.
In my last article I gave an
explanation of taxation of In-
tangible Assets. I will now
show; something of its practical
workings under the law passed
by the Thirtieth Legislature.
There . are in Brown county
28.14 miles of the G. C. & S. F.
R.fR. Co. the intangible assets
of which as ascertained by the
tax board was $327505.00. This
was placed upon the tax rolls of
Brown county at $43S00.00.
There are in Brown county 39.33
miles of the F.W.&R.G. Ry. Co.
(Frisco) of railroad the intangi-
ble value of which as ascertain-
ed by the tax board was $379-
475.00. This was placed upon
the tax rolls of Brown county at
$47005.00.
The total amount of intangible
assets of railroads in Brown
county last year was $7069S0.00.
The total amount of intangible
assets upon which the railroads
paidjtaxes was$90305.00;amount
upon railroads escapeed taxation
in Brown county last year$616-
175.00. Under the act of the
Thirtieth Legislature Commis-
sioners Courts have no power to
reduce the values of intangible
assets as found by the state tax
board. By reason of this law
the tax?ble values of railroads
will' be increased this year in
Brown county $616175.00 and ; thought it was a hurrah at first
yet as shown in my previous
article explanatory of taxation
of .intangible assets they will
not be required to pay taxes
above their true value. Total
intangible value of all railroadsjin
Texas for 1906 as found by the
state tax board $152 827760.00.
Total amount of intangible assets
of railroads in Texas as fixed by
Commissoners Courts $30 $03-
04800. Amount of railroad
values that escaped taxation in
Texas last year $122024712.00.
The intangible tax law has
been held by oursuprme court
to be constitutional and it': was
also held by said court that -the
Commissioners Court had : no
power to reduce the intangible
values as fixed by the state
board. This power; is expressly
denied by the act of) the Thir-
tieth Legislature.
