TAKE NOTICE that an elec-
tion will be held on the 18th day
of April, 1953, in said County,
In obedience to an order duly
entered by the Commissioners'
Court on the 9th day of March,
1953, which Is as follows:

1953, the Commissioners' Court
of Gaines County, Texas, con-
vened In regular session, at the
regular meeting place thereof
In the Courthouse at Seminole,
Texas, with the following mem-

Commissioner Cornet t intro-
duced an order and moved its
adoption. The motion was sec
ondcd by Commissioner March
banks. The motion, carrying with
it the adoption of the order, pre
vailed by the following vote:

the order Is as follows:
WHEREAS, at the general
election held throughout the
State of Texas on November 7,
1944, the qualified electors of
the State, voting on the proposi-
tion, approved the amendment
to Section 9 of Article 8, of the
Texas Constitution which amend-
ment provides that the Commis-
sioners' Court in any county
may re-aMocate the county tax
levies authorized in said Section
9 of Artlclo 8, by changing the
rates provided for any of the
purposes authorized In said Sec-
tion by either increasing or de-
creasing the same but in no
event shall total of such taxes
exceed Eighty (80c) Cents on
the one hundred dollars' valua-
tion for any one year, provided
that before the Commissioners'
Court may make such re-alloca-
tions and changes In such levies
the same shall be submitted to
the qualified property taxpay
Ing voters of such county at a
general or special election! and
In event such re-allocatlons and
changes are approved by a ma-
jority of the qualified property
taxpaying voters of any such
County, such re-allocations and
changes shall remain In force
and effect for a period of six
(6) years from the date of the
election at which same shall
have been approved, unless the
«ame again shall have been
changed by a majority of the
qualified property taxpaying
voters of such county, votlns on
the proposition; and
WHEREAS, the Commission-
ers' Court of Gaines County,
Texas, deems it advisable and
to the best interest of said
County to reallocate the county
taxes authorized to be levied an-
nually by Section 9, Article 8, of
the Constitution, by changing the
rates In respect to certain coun-
ty taxes as herein provided;
THEREFORE, BE IT ORDER-
ED BY THE COMMISSIONERS'
COURT OK GAINES COUNTY,
TEXAS:
That a special election be held
In said County on the 18th day
of April. 1953, which is not loss
than thirty (30) days from the
date of the adoption of this or-
der, at which election the fol-
lowing proposition shall be sub-
mitted to the qualified property
taxpaying voters, who own tax-
able property In said County and
who have duly rendered the
same for taxation, for their ac-
tion thereupon:
"Shall the Commissi oners'
Court of Gaines County, Texas,
be authorized to levy and collect
in each year for a period of six
(6) years from the date of said
election, county taxes as fol-
lows:
Not exceeding Korty Cents
(40c) on the $100,00 valuation,
In any one year, for County pur
poses;
Not exceeding Forty Cents
(40c) on the $100.00 valuation
in any one year, for roads and
bridges;
Not exceeding Five Cents
(5c) on the $100.00 valuation,
In any one year, to supplement
the jury fund of the County; and
Not exceeding Thirty Cents Paymaster

in any one year, for the erection
of public buildings anil other
permanent Improvements,
"Provided, however, that in no
event shall the total county taxes
for any one year, levied for the
four purposes above mention,
total more than (80c) on the'one
hundred dollars valuation."
In the event that the annual
levy of a tax nut exceeding Fif-
teen (15c) cents on the one hun-
dred dollars' valuation for the
further maintenance of the pub-
lic roads of said County hns
heretofore been, or shall here-
after be, authorized by a major-
ity of the qualified property tax-
paying voters of the County, vot-
ing at an election held for that
purpose, nothing herein shall be
construed as rescinding or In
any manner affecting the power
and authority of the Commis-
sioners' Court to levy and to
continue to levy said tax.
The said election shall be held
under the provisions of the Con-
stitution and laws of the State
of Texas, particularly amended
Section 9, of Article 8, of the
Constitution, and Section 3a, Ar>
tide 0, of the Constitution, and
all persons who are legally qual-
ified voters of said County, and
who are resident property tax-
payers who own taxable prop-

erty In said County and who
have duly rendered the same for
taxation, shall be entitled to vote
at said election.
The ballots for said election
shall have written or printed
thereon the following:
"FOR RE-ALLOCATION OF
COUNTY TAXES,"
"AGAINST RE-ALLOCATION
OF COUNTY TAXES."
Each voter shall mark out
with black Ink or black pencil
one of the above expressions
thus leaving the other as Indicat-
ing his or her vote.
The polling places and presid-
ing officers of said election
shall be respectively as follows:

given by posting a copy of this
order afc the top of which shall
appear the words "NOTICE OK
ELECTION FOR THE RE-AL-
LOCATION OF COUNTY TAX-
ES," at the Courthouse door of
said County, and In each of the
election precincts of said County
for thirty (30) days prior to the
election, which notices shall be
posted by the Sheriff or a Con-
stable, who shall make return
on a copy of such notice, how
and when he executed the same,
Notice of said election shall
also be given by publication
thereof In a newspaper publish-
ed In Gaines County, one each
week for three consecutive
weeks, the date of first publica-
tion being not loss than twenty-
one (21) full days prior to the
date of said election.
