ITS THE LAW
Extraordinary Write
Over the ages one branch of
the law, equity, ha* devised ex- (
traordinary writ* to meet «p®-|
rial need*. Before equity, only
the king, ax a boon, could erartt
order* to do or *top (something. I
In contract the law court* dealt j
almost nolely with *ettling mon-
ey matters.
Some of these extraordinary
writs hav«* come and lasted in
our law:
1. Mandamus I Latin "we
command") direct* a person,
corporation, government offi-
cers, or a lower court to do a
certain thing on pain of con-
tempt of court, with other pen-
akie« for failure to obey.
The person asking for man-
damus must show the court
that he ha* a right to hav«
something done, say, to enforce
a private or public right. Man-
damus can ordpr a public offi-
cer to give a taxpayer a hear-
ing or let him vote; or a pri-
vate person may want to have
his fence r"l»airpd or hi* neigh-
bor's land shored up.
2. tyuo Warranto < By what
right do you hold office or po-
sition?! This writ make* a ffr-
son, corporation, public offi-
cial, or municipality say by
what legal ritfht it holds office,
exercise* powers, franchise, and
privilege*.
Thus a citizen can question
an election, an annexation or
an area in the ritv, or certain
illegal action taken by a cor-
poiation or fraternal group. Of-
ten the citizen murt have the
attorney general start the quo
warranto proceeding.
■f. Prohibition stops a court
promptly from going on with
a cas.. if it lacks legal right to
do o, especially if one can
trip, the bride was wearing a
blue print silk 'Ires? anil blue
coat with white accessories. She
wore the orchid from her hou-
<|U''t as a corsage.
The bridegroom attended
T'-vi Tei h, at Lubbock, and is
now liiinif in Phoenix, where
the couple will make their
home.
