of Conner in the newspapers
and remarked to Miller that they

Phoenix Arizona under that name
and the came back and that later
he shipped part of them to Blake
under the name of Murphy at
some place in California and they
didnt come back and that he
shipped some of them to Oklahoma
in that name and they were
not returned

one introduced in evidence by the
State and that it had been given
her by Bronie Miller and that she
missed it shortly after Blake stayj
ed at her houe just before the
Conner killing

that ho had been in the hardware
buslnes for sixteen years handling

125 caliber automatic pistol bullets

time of the killing he lived in
Slaton and was City Marshall
That he found the Conner car on I
the streets of Slaton about three
blocks north of the square That
it was found there about 11
oclock of July 17th and that he
took it to the garage and put il

and glasses had been taken
out and boxed before bringing the
car back to Tulia j

Barney Finn of Ft Worth Texas I
testified that he had been con J

of Ft Worth for more than sixteen

On cross examination by Mr Martin
for the State ho admitted that
ho had not examined tho defendant
personally and that his answer
was based upon tho truthfulness
of tho hypothetical question
asked and that if tho question did
not recito tho truo facts that his
answer then would bo orroneous
He also stated that In his opinion
practclally everyon who commits
a crlmo Is Insanse Whon asked
by Attorney Martin whether or
not ln his opinion a negro who
came down a walk and mot a
white girl and being overcome by
a consuming passion for liwt
should ravish tho white girl such
negro would bo Insane tho doctor
answered yes
Jimmlo Blako brother of the de
fondant testified thathis brother
was addicted to tho use of mor
pliinc and that In his opinion ho
was insane at tho time ho killed
Connor That ho had boon a good
hoy and good student up to the
time he used narcotics that thereafter
ho had become unruly
would give cold checks stay out
late at night not oboy his parents
drank whiskey married
while he was 17 years of age and
had gone away from home and
that he heard it thunder at onetime
when tho sky was clear and
that ho at one time had gone to
El Paso and bought somo morphine
at Jaurez Moxico
The defendant closed his case
with this and the State put on in
rebuttal to this the testimony of
Verna Chandler who stated that
in her opinion there was nothing
wrong with Blako at the time she
saw him in July 1925 that he ms
brighter than the other boys going
with her
Mrs Dr Lee of Clorado Texas
testified thnt she was a sister oi
John J Miller and that she had
seen Blake in July 1925 at Millers
house and had talked with
him for more than two hours
and that she did not observe anything
out of the usual in his conductSheriff Walters testified that
Blake was sane and that the only
time he observed anything wrong
with him was when he was in the
presence of the jury
Rr Stevens of Tulia testified
that he had examined the defendant
in jail and IukJ tilked to
him and that he found nothing
wrong with hlm that he was normal
and that in his opinion he
was sane
The State and defendant both
closed their testimony at about
2 oclock and iho court took ml
